66 AN ACT
77 relating to liability for obtaining improper unemployment
88 compensation benefits.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. The heading to Section 214.002, Labor Code, is
1111 amended to read as follows:
1212 Sec. 214.002. LIABILITY FOR [IMPROPERLY] OBTAINING
1313 IMPROPER BENEFITS.
1414 SECTION 2. Section 214.002(b), Labor Code, is amended to
1515 read as follows:
1616 (b) In this section, "improper benefit" means:
1717 (1) the benefit obtained by a person:
1818 (A) [(1)] because of the nondisclosure or
1919 misrepresentation by the person or by another of a material fact,
2020 without regard to whether the nondisclosure or misrepresentation
2121 was known or fraudulent; and
2222 (B) [(2)] while:
2323 (i) [(A)] any condition imposed by this
2424 subtitle for the person's qualifying for the benefit was not
2525 fulfilled in the person's case; or
2626 (ii) [(B)] the person was disqualified from
2727 receiving benefits; or
2828 (2) the benefit obtained by a person because of
2929 commission error.
3030 SECTION 3. Section 214.002, Labor Code, as amended by this
3131 Act, applies only to a claim for unemployment compensation benefits
3232 filed with the Texas Workforce Commission on or after the effective
3333 date of this Act. A claim filed before the effective date of this
3434 Act is governed by the law in effect on the date the claim was filed,
3535 and the former law is continued in effect for that purpose.
3636 SECTION 4. This Act takes effect September 1, 2019.
