| 7 | 7 | | relating to the duties of the Texas Water Development Board. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 2306.590(d), Government Code, is amended |
|---|
| 10 | 10 | | to read as follows: |
|---|
| 11 | 11 | | (d) The committee shall: |
|---|
| 12 | 12 | | (1) review the progress of colonia water and |
|---|
| 13 | 13 | | wastewater infrastructure projects managed by the Texas Water |
|---|
| 14 | 14 | | Development Board and the state agency responsible for |
|---|
| 15 | 15 | | administering the portion of the federal community development |
|---|
| 16 | 16 | | block grant nonentitlement program that addresses the |
|---|
| 17 | 17 | | infrastructure needs of colonias; |
|---|
| 18 | 18 | | (2) present an update and make recommendations to the |
|---|
| 19 | 19 | | board and the Texas Water Development Board annually at a [the] |
|---|
| 20 | 20 | | joint meeting [required by Section 6.060(d), Water Code,] |
|---|
| 21 | 21 | | regarding: |
|---|
| 22 | 22 | | (A) efforts to ensure that colonia residents are |
|---|
| 23 | 23 | | connected to the infrastructure funded by state agencies; |
|---|
| 24 | 24 | | (B) the financial, managerial, and technical |
|---|
| 25 | 25 | | capabilities of project owners and operators; |
|---|
| 26 | 26 | | (C) the agencies' management of their colonia |
|---|
| 27 | 27 | | programs and the effectiveness of their policies regarding |
|---|
| 28 | 28 | | underperforming projects; and |
|---|
| 29 | 29 | | (D) any other issues related to the effect of |
|---|
| 30 | 30 | | state-managed infrastructure programs on colonia residents; |
|---|
| 31 | 31 | | (3) review public comments regarding the colonia needs |
|---|
| 32 | 32 | | assessment incorporated into the state low income housing plan |
|---|
| 33 | 33 | | under Section 2306.0721; and |
|---|
| 34 | 34 | | (4) based on the public comments reviewed under |
|---|
| 35 | 35 | | Subdivision (3), recommend to the board new colonia programs or |
|---|
| 36 | 36 | | improvements to existing colonia programs. |
|---|
| 37 | 37 | | SECTION 2. Sections 6.060(d), 16.022, and 17.1245(b), Water |
|---|
| 38 | 38 | | Code, are repealed. |
|---|
| 39 | 39 | | SECTION 3. This Act takes effect September 1, 2019. |
