11 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
12 | 10 | SECTION 1. Subchapter B, Chapter 112, Transportation Code, | |
13 | 11 | is amended by adding Section 112.063 to read as follows: | |
14 | 12 | Sec. 112.063. HIGH-SPEED RAIL TECHNOLOGIES. (a) In this | |
15 | 13 | section: | |
16 | 14 | (1) "High-speed rail" means passenger service that is | |
17 | 15 | reasonably expected to reach speeds of at least 110 miles per hour. | |
18 | 16 | (2) "Rail facility" has the meaning assigned by | |
19 | 17 | Section 91.001. | |
20 | 18 | (b) A private entity that constructs a rail facility for | |
21 | - | high-speed rail service shall ensure that the rail facility: | |
22 | - | (1) at a minimum, complies with regulations for that | |
23 | - | type of rail facility adopted by the Federal Railroad | |
24 | - | Administration in 49 C.F.R. Chapter II in effect on January 31, | |
25 | - | 2019, regardless of whether the rail facility is an intrastate or | |
26 | - | interstate facility or whether a waiver of federal law has been | |
27 | - | granted for the rail facility; | |
28 | - | (2) is compatible with train technology that exists at | |
29 | - | the time construction begins; and | |
30 | - | (3) does not interfere with the use of other rail | |
31 | - | facilities or train technologies in use at the time construction | |
32 | - | begins. | |
