89 relating to authorizing the issuance of revenue bonds to fund
910 capital projects at certain public institutions of higher
1011 education.
1112 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1213 SECTION 1. Subchapter B, Chapter 55, Education Code, is
1314 amended by adding Sections 55.1791, 55.1792, 55.1793, 55.1794,
1415 55.1795, 55.1796, 55.1797, 55.1798, 55.1799, 55.17991, and
1516 55.17992 to read as follows:
1617 Sec. 55.1791. THE TEXAS A&M UNIVERSITY SYSTEM; ADDITIONAL
1718 BONDS. (a) In addition to the other authority granted by this
1819 subchapter, the board of regents of The Texas A&M University System
1920 may acquire, purchase, construct, improve, renovate, enlarge, or
2021 equip property and facilities, including roads and related
2122 infrastructure, for projects to be financed through the issuance of
2223 bonds in accordance with this subchapter and in accordance with a
2324 systemwide revenue financing program adopted by the board for the
2425 following institutions, not to exceed the following aggregate
2526 principal amounts for the projects specified, as follows:
2627 (1) Prairie View A&M University, $60 million for
2728 construction of an engineering classroom and research building;
2829 (2) Tarleton State University, $72 million for
2930 construction of an agricultural and natural resources building;
3031 (3) Texas A&M University:
3132 (A) $65 million for construction of an
3233 instructional laboratory and innovative learning facility; and
3334 (B) $30 million for construction of a research
3435 facility and nursing instruction center at the Higher Education
3536 Center in McAllen, Texas;
3637 (4) Texas A&M University--Central Texas, $25 million
3738 for construction of a central utility plant;
3839 (5) Texas A&M University--Commerce, $49.5 million for
3940 construction of an agriculture multipurpose education and training
4041 center;
4142 (6) Texas A&M University--Corpus Christi, $58.5
4243 million for construction of an arts and media building;
4344 (7) Texas A&M University at Galveston, $40 million for
4445 construction of an immersive scholarship and learning environment
4546 building, a central plant, and campus infrastructure;
4647 (8) Texas A&M International University, $60 million
4748 for construction of a student classroom and events center;
4849 (9) Texas A&M University--Kingsville, $60 million for
4950 construction of a STEM and health professions workforce development
5051 complex;
5152 (10) Texas A&M University--San Antonio, $53 million
5253 for construction of an academic and library building;
5354 (11) Texas A&M University--Texarkana, $46 million for
5455 construction of a business, engineering, and technology building;
5556 (12) West Texas A&M University:
5657 (A) $28.5 million for capital improvements to
5758 address life and fire safety issues; and
5859 (B) $20 million for renovation of the education
5960 building; and
6061 (13) The Texas A&M University System Health Science
6162 Center, $100 million for a joint project with The University of
6263 Texas M. D. Anderson Cancer Center and The University of Texas
6364 Health Science Center at Houston for construction of a biomedical
6465 research facility.
6566 (b) The board may pledge irrevocably to the payment of bonds
6667 authorized by this section all or any part of the revenue funds of
6768 an institution, branch, or entity of The Texas A&M University
6869 System, including student tuition charges. The amount of a pledge
6970 made under this subsection may not be reduced or abrogated while the
7071 bonds for which the pledge is made, or bonds issued to refund those
7172 bonds, are outstanding.
7273 (c) If sufficient funds are not available to the board to
7374 meet its obligations under this section, the board may transfer
7475 funds among institutions, branches, and entities of The Texas A&M
7576 University System to ensure the most equitable and efficient
7677 allocation of available resources for each institution, branch, or
7778 entity to carry out its duties and purposes.
7879 Sec. 55.1792. THE UNIVERSITY OF TEXAS SYSTEM; ADDITIONAL
7980 BONDS. (a) In addition to the other authority granted by this
8081 subchapter, the board of regents of The University of Texas System
8182 may acquire, purchase, construct, improve, renovate, enlarge, or
8283 equip property and facilities, including roads and related
8384 infrastructure, for projects to be financed through the issuance of
8485 bonds in accordance with this subchapter and in accordance with a
8586 systemwide revenue financing program adopted by the board for the
8687 following institutions, not to exceed the following aggregate
8788 principal amounts for the projects specified, as follows:
8889 (1) The University of Texas at Arlington:
8990 (A) $76 million for construction of a social work
9091 and college of nursing academic building; and
9192 (B) $59 million for rehabilitation and
9293 renovation of the life sciences building;
9394 (2) The University of Texas at Austin, $135 million
9495 for restoration of the J. T. Patterson Labs building;
9596 (3) The University of Texas at Dallas:
9697 (A) $60 million for a joint project with The
9798 University of Texas Southwestern Medical Center at Dallas for
9899 construction of a translational biomedical engineering and science
99100 building on The University of Texas Southwestern Medical Center at
100101 Dallas campus; and
101102 (B) $75 million for construction of a student
102103 success center on The University of Texas at Dallas campus;
103104 (4) The University of Texas at El Paso, $113 million
104105 for construction of an advanced teaching and learning complex;
105106 (5) The University of Texas of the Permian Basin, $40
106107 million for improvement and renovation of the Mesa building;
107108 (6) The University of Texas--Rio Grande Valley, $70
108109 million for construction of a health affairs building;
109110 (7) The University of Texas at San Antonio,
110111 $126,250,000 for construction of a college of business building at
111112 the downtown campus;
112113 (8) The University of Texas at Tyler, $50 million for
113114 construction of a college of nursing and health science building;
114115 (9) The University of Texas Health Science Center at
115116 Houston, $100 million for a joint project with The Texas A&M
116117 University System Health Science Center and The University of Texas
117118 M. D. Anderson Cancer Center for construction of a biomedical
118119 research facility;
119120 (10) The University of Texas Health Science Center at
120121 San Antonio, $82 million for construction of the Glenn Biggs
121122 Institute for Alzheimer's & Neurodegenerative Diseases building;
122123 (11) The University of Texas Health Science Center at
123124 Tyler, $18,521,432 for improvement and renovation of a biomedical
124125 research building;
125126 (12) The University of Texas M. D. Anderson Cancer
126127 Center, $100 million for a joint project with The Texas A&M
127128 University System Health Science Center and The University of Texas
128129 Health Science Center at Houston for construction of a biomedical
129130 research facility;
130131 (13) The University of Texas Medical Branch at
131132 Galveston, $120 million for construction of an education and
132133 clinical multiuse building; and
133134 (14) The University of Texas Southwestern Medical
134135 Center at Dallas:
135136 (A) $60 million for a joint project with The
136137 University of Texas at Dallas for construction of a translational
137138 biomedical engineering and science building on The University of
138139 Texas Southwestern Medical Center at Dallas campus; and
139140 (B) $60 million for construction of the Peter
140141 O'Donnell Jr. Brain Institute research facility.
141142 (b) The board may pledge irrevocably to the payment of bonds
142143 authorized by this section all or any part of the revenue funds of
143144 an institution, branch, or entity of The University of Texas
144145 System, including student tuition charges. The amount of a pledge
145146 made under this subsection may not be reduced or abrogated while the
146147 bonds for which the pledge is made, or bonds issued to refund those
147148 bonds, are outstanding.
148149 (c) If sufficient funds are not available to the board to
149150 meet its obligations under this section, the board may transfer
150151 funds among institutions, branches, and entities of The University
151152 of Texas System to ensure the most equitable and efficient
152153 allocation of available resources for each institution, branch, or
153154 entity to carry out its duties and purposes.
154155 Sec. 55.1793. UNIVERSITY OF HOUSTON SYSTEM; ADDITIONAL
155156 BONDS. (a) In addition to the other authority granted by this
156157 subchapter, the board of regents of the University of Houston
157158 System may acquire, purchase, construct, improve, renovate,
158159 enlarge, or equip property and facilities, including roads and
159160 related infrastructure, for projects to be financed through the
160161 issuance of bonds in accordance with this subchapter and in
161162 accordance with a systemwide revenue financing program adopted by
162163 the board for the following entity and institutions, not to exceed
163164 the following aggregate principal amounts for the projects
164165 specified, as follows:
165166 (1) the University of Houston System, $50 million for
166167 construction of an academic, administration, and student services
167168 building on the Katy, Texas, campus;
168169 (2) the University of Houston:
169170 (A) $50 million for construction of a law center
170171 building; and
171172 (B) $35 million for construction of the Hobby
172173 School for Public Affairs building;
173174 (3) the University of Houston--Clear Lake, $56 million
174175 for Phase II of the STEM and classroom building construction;
175176 (4) the University of Houston--Downtown:
176177 (A) $85 million for construction of an arts,
177178 sciences, engineering, entrepreneurship, collaboration retention,
178179 and academic engagement facility; and
179180 (B) $15 million for repurposing the Student Life
180181 Center as a student union building; and
181182 (5) the University of Houston--Victoria, $60 million
182183 for campus expansion.
183184 (b) The board may pledge irrevocably to the payment of bonds
184185 authorized by this section all or any part of the revenue funds of
185186 an institution, branch, or entity of the University of Houston
186187 System, including student tuition charges. The amount of a pledge
187188 made under this subsection may not be reduced or abrogated while the
188189 bonds for which the pledge is made, or bonds issued to refund those
189190 bonds, are outstanding.
190191 (c) If sufficient funds are not available to the board to
191192 meet its obligations under this section, the board may transfer
192193 funds among institutions, branches, and entities of the University
193194 of Houston System to ensure the most equitable and efficient
194195 allocation of available resources for each institution, branch, or
195196 entity to carry out its duties and purposes.
196197 Sec. 55.1794. TEXAS STATE UNIVERSITY SYSTEM; ADDITIONAL
197198 BONDS. (a) In addition to the other authority granted by this
198199 subchapter, the board of regents of the Texas State University
199200 System may acquire, purchase, construct, improve, renovate,
200201 enlarge, or equip property and facilities, including roads and
201202 related infrastructure, for projects to be financed through the
202203 issuance of bonds in accordance with this subchapter and in
203204 accordance with a systemwide revenue financing program adopted by
204205 the board for the following institutions, not to exceed the
205206 following aggregate principal amounts for the projects specified,
206207 as follows:
207208 (1) Lamar University, $45 million for construction of
208209 a digital learning center;
209210 (2) Lamar State College--Orange, $32 million for
210211 construction of an academic building;
211212 (3) Lamar State College--Port Arthur:
212213 (A) $20 million for construction of an allied
213214 health building; and
214215 (B) $1,012,500 for construction of a workforce
215216 training center;
216217 (4) Lamar Institute of Technology:
217218 (A) $20 million for construction of a workforce
218219 training center; and
219220 (B) $1,100,000 for construction of a
220221 professional truck driving academy building;
221222 (5) Sam Houston State University, $70 million for
222223 construction of an allied health building;
223224 (6) Sul Ross State University, $25.5 million for
224225 expansion of the fine arts facility;
225226 (7) Sul Ross State University Rio Grande College, $20
226227 million for construction of an education center located in Eagle
227228 Pass, Texas; and
228229 (8) Texas State University:
229230 (A) $90 million for construction of a STEM
230231 classroom building located in San Marcos, Texas; and
231232 (B) $45 million for construction of a health
232233 professions building located in Round Rock, Texas.
233234 (b) The board may pledge irrevocably to the payment of bonds
234235 authorized by this section all or any part of the revenue funds of
235236 an institution, branch, or entity of the Texas State University
236237 System, including student tuition charges. The amount of a pledge
237238 made under this subsection may not be reduced or abrogated while the
238239 bonds for which the pledge is made, or bonds issued to refund those
239240 bonds, are outstanding.
240241 (c) If sufficient funds are not available to the board to
241242 meet its obligations under this section, the board may transfer
242243 funds among institutions, branches, and entities of the Texas State
243244 University System to ensure the most equitable and efficient
244245 allocation of available resources for each institution, branch, or
245246 entity to carry out its duties and purposes.
246247 Sec. 55.1795. UNIVERSITY OF NORTH TEXAS SYSTEM; ADDITIONAL
247248 BONDS. (a) In addition to the other authority granted by this
248249 subchapter, the board of regents of the University of North Texas
249250 System may acquire, purchase, construct, improve, renovate,
250251 enlarge, or equip property and facilities, including roads and
251252 related infrastructure, for projects to be financed through the
252253 issuance of bonds in accordance with this subchapter and in
253254 accordance with a systemwide revenue financing program adopted by
254255 the board for the following institutions, not to exceed the
255256 following aggregate principal amounts for the projects specified,
256257 as follows:
257258 (1) the University of North Texas, $126 million for
258259 construction of a science and technology research building;
259260 (2) the University of North Texas at Dallas, $80
260261 million for construction of a STEM building; and
261262 (3) the University of North Texas Health Science
262263 Center at Fort Worth, $115.5 million for construction of an
263264 academic building.
264265 (b) The board may pledge irrevocably to the payment of bonds
265266 authorized by this section all or any part of the revenue funds of
266267 an institution, branch, or entity of the University of North Texas
267268 System, including student tuition charges. The amount of a pledge
268269 made under this subsection may not be reduced or abrogated while the
269270 bonds for which the pledge is made, or bonds issued to refund those
270271 bonds, are outstanding.
271272 (c) If sufficient funds are not available to the board to
272273 meet its obligations under this section, the board may transfer
273274 funds among institutions, branches, and entities of the University
274275 of North Texas System to ensure the most equitable and efficient
275276 allocation of available resources for each institution, branch, or
276277 entity to carry out its duties and purposes.
277278 Sec. 55.1796. TEXAS WOMAN'S UNIVERSITY; ADDITIONAL BONDS.
278279 (a) In addition to the other authority granted by this subchapter,
279280 the board of regents of Texas Woman's University may acquire,
280281 purchase, construct, improve, renovate, enlarge, or equip property
281282 and facilities, including roads and related infrastructure, for a
282283 health sciences center, to be financed through the issuance of
283284 bonds in accordance with this subchapter, not to exceed the
284285 aggregate principal amount of $100 million.
285286 (b) The board may pledge irrevocably to the payment of bonds
286287 authorized by this section all or any part of the revenue funds of
287288 Texas Woman's University, including student tuition charges. The
288289 amount of a pledge made under this subsection may not be reduced or
289290 abrogated while the bonds for which the pledge is made, or bonds
290291 issued to refund those bonds, are outstanding.
291292 Sec. 55.1797. MIDWESTERN STATE UNIVERSITY; ADDITIONAL
292293 BONDS. (a) In addition to the other authority granted by this
293294 subchapter, the board of regents of Midwestern State University may
294295 acquire, purchase, construct, improve, renovate, enlarge, or equip
295296 property and facilities, including roads and related
296297 infrastructure, for infrastructure upgrades, to be financed
297298 through the issuance of bonds in accordance with this subchapter,
298299 not to exceed the aggregate principal amount of $10 million.
299300 (b) The board may pledge irrevocably to the payment of bonds
300301 authorized by this section all or any part of the revenue funds of
301302 Midwestern State University, including student tuition charges.
302303 The amount of a pledge made under this subsection may not be reduced
303304 or abrogated while the bonds for which the pledge is made, or bonds
304305 issued to refund those bonds, are outstanding.
305306 Sec. 55.1798. STEPHEN F. AUSTIN STATE UNIVERSITY;
306307 ADDITIONAL BONDS. (a) In addition to the other authority granted
307308 by this subchapter, the board of regents of Stephen F. Austin State
308309 University may acquire, purchase, construct, improve, renovate,
309310 enlarge, or equip property and facilities, including roads and
310311 related infrastructure, for a natural resources science and
311312 innovations laboratory, to be financed through the issuance of
312313 bonds in accordance with this subchapter, not to exceed the
313314 aggregate principal amount of $48 million.
314315 (b) The board may pledge irrevocably to the payment of bonds
315316 authorized by this section all or any part of the revenue funds of
316317 Stephen F. Austin State University, including student tuition
317318 charges. The amount of a pledge made under this subsection may not
318319 be reduced or abrogated while the bonds for which the pledge is
319320 made, or bonds issued to refund those bonds, are outstanding.
320321 Sec. 55.1799. TEXAS TECH UNIVERSITY SYSTEM; ADDITIONAL
321322 BONDS. (a) In addition to the other authority granted by this
322323 subchapter, the board of regents of the Texas Tech University
323324 System may acquire, purchase, construct, improve, renovate,
324325 enlarge, or equip property and facilities, including roads and
325326 related infrastructure, for projects to be financed through the
326327 issuance of bonds in accordance with this subchapter and in
327328 accordance with a systemwide revenue financing program adopted by
328329 the board for the following institutions, not to exceed the
329330 following aggregate principal amounts for the projects specified,
330331 as follows:
331332 (1) Angelo State University, $22.5 million for
332333 construction of a college of arts and humanities building;
333334 (2) Texas Tech University, $118,080,000 for
334335 construction of a science and engineering complex;
335336 (3) Texas Tech University Health Sciences Center:
336337 (A) $34,650,000 for expansion of the academic and
337338 clinic building located in Amarillo, Texas; and
338339 (B) $55 million for expansion of the Texas Tech
339340 University Health Sciences building in Midland, Texas; and
340341 (4) Texas Tech University Health Sciences Center at El
341342 Paso, $92,349,000 for construction of a dental school building.
342343 (b) The board may pledge irrevocably to the payment of bonds
343344 authorized by this section all or any part of the revenue funds of
344345 an institution, branch, or entity of the Texas Tech University
345346 System, including student tuition charges. The amount of a pledge
346347 made under this subsection may not be reduced or abrogated while the
347348 bonds for which the pledge is made, or bonds issued to refund those
348349 bonds, are outstanding.
349350 (c) If sufficient funds are not available to the board to
350351 meet its obligations under this section, the board may transfer
351352 funds among institutions, branches, and entities of the Texas Tech
352353 University System to ensure the most equitable and efficient
353354 allocation of available resources for each institution, branch, or
354355 entity to carry out its duties and purposes.
355356 Sec. 55.17991. TEXAS SOUTHERN UNIVERSITY; ADDITIONAL
356357 BONDS. (a) In addition to the other authority granted by this
357358 subchapter, the board of regents of Texas Southern University may
358359 acquire, purchase, construct, improve, renovate, enlarge, or equip
359360 property and facilities, including roads and related
360361 infrastructure, for deferred maintenance for campus facilities, to
361362 be financed through the issuance of bonds in accordance with this
362363 subchapter, not to exceed the aggregate principal amount of $50
363364 million.
364365 (b) The board may pledge irrevocably to the payment of bonds
365366 authorized by this section all or any part of the revenue funds of
366367 Texas Southern University, including student tuition charges. The
367368 amount of a pledge made under this subsection may not be reduced or
368369 abrogated while the bonds for which the pledge is made, or bonds
369370 issued to refund those bonds, are outstanding.
370371 Sec. 55.17992. TEXAS STATE TECHNICAL COLLEGE SYSTEM. (a)
371372 In addition to the other authority granted by this subchapter, the
372373 board of regents of the Texas State Technical College System may
373374 acquire, purchase, construct, improve, renovate, enlarge, or equip
374375 property and facilities, including roads and related
375376 infrastructure, for projects to be financed through the issuance of
376377 bonds in accordance with this subchapter for the following entity
377378 and institutions, not to exceed the following aggregate principal
378379 amounts for the projects specified, as follows:
379380 (1) Texas State Technical College System, $16.5
380381 million for Phase II of the industrial technology center located in
381382 Williamson County;
382383 (2) Texas State Technical College--Fort Bend,
383384 $30,377,000 for Phase III of the campus construction;
384385 (3) Texas State Technical College--Harlingen, $20
385386 million for construction of an industrial technology center;
386387 (4) Texas State Technical College--Marshall,
387388 $8,572,000 for consolidation construction for a single campus;
388389 (5) Texas State Technical College--North Texas,
389390 $10,938,000 for Phase II of the new campus construction;
390391 (6) Texas State Technical College--Waco, $20 million
391392 for construction of a computer technology center; and
392393 (7) Texas State Technical College--West Texas,
393394 $28,177,000 for Phase II of the Abilene campus construction.
394395 (b) The board may pledge irrevocably to the payment of bonds
395396 authorized by this section all or any part of the revenue funds of
396397 an institution, branch, or entity of the Texas State Technical
397398 College System, including student tuition charges. The amount of a
398399 pledge made under this subsection may not be reduced or abrogated
399400 while the bonds for which the pledge is made, or bonds issued to
400401 refund those bonds, are outstanding.
401402 (c) If sufficient funds are not available to the board to
402403 meet its obligations under this section, the board may transfer
403404 funds among institutions, branches, and entities of the Texas State
404405 Technical College System to ensure the most equitable and efficient
405406 allocation of available resources for each institution, branch, or
406407 entity to carry out its duties and purposes.
407408 SECTION 2. This Act does not affect any authority or
408409 restriction regarding the activities that a public institution of
409410 higher education may conduct in connection with a facility financed
410411 by bonds authorized by this Act.
411412 SECTION 3. This Act takes effect September 1, 2019.
