55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the enforcement of traffic regulations on a public road
88 that is owned, operated, and maintained by a special district.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 791.036, Government Code, is amended to
1111 read as follows:
1212 Sec. 791.036. REGULATION OF TRAFFIC IN SPECIAL DISTRICTS.
1313 The commissioners court of a county may enter into an interlocal
1414 contract with the board of a special district for the county to:
1515 (1) apply the county's traffic regulations to a public
1616 road in the county that is owned, operated, and maintained by the
1717 district if the commissioners court finds that it is in the county's
1818 interest to regulate traffic on the public road; and
1919 (2) enforce the regulations.
2020 SECTION 2. Section 251.151(b), Transportation Code, is
2121 amended to read as follows:
2222 (b) Under the terms of an interlocal contract under Section
2323 791.036, Government Code, the [The] commissioners court of a county
2424 may:
2525 (1) by order apply the county's traffic regulations to
2626 a public road in the county that is owned, operated, and maintained
2727 by a special district and located wholly or partly in the county;
2828 and
2929 (2) provide for the enforcement of the regulations [if
3030 the commissioners court and the board of the district have entered
3131 into an interlocal contract under Section 791.036, Government
3232 Code].
3333 SECTION 3. This Act takes effect immediately if it receives
3434 a vote of two-thirds of all the members elected to each house, as
3535 provided by Section 39, Article III, Texas Constitution. If this
3636 Act does not receive the vote necessary for immediate effect, this
3737 Act takes effect September 1, 2019.
