96 relating to conditions of community supervision for defendants
107 convicted of certain criminal offenses involving animals.
118 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
12- SECTION 1. Article 42A.511(b), Code of Criminal Procedure,
13- as added by Chapter 739 (S.B. 1232), Acts of the 85th Legislature,
14- Regular Session, 2017, is amended to read as follows:
15- (b) If a judge grants community supervision to a defendant
16- convicted of an offense under Section 21.09, 42.09, 42.091, 42.092,
17- 42.10, or 42.105, Penal Code, the judge may:
9+ SECTION 1. Article 42A.511, Code of Criminal Procedure, is
10+ amended to read as follows:
11+ Art. 42A.511. COMMUNITY SUPERVISION FOR CERTAIN OFFENSES
12+ INVOLVING ANIMALS. If a judge grants community supervision to a
13+ defendant convicted of an offense under Section 21.09, 42.09,
14+ 42.091, 42.092, 42.10, or 42.105, Penal Code, the judge may:
1815 (1) require the defendant to relinquish custody of any
1916 animals in the defendant's possession;
2017 (2) prohibit the defendant from possessing or
2118 exercising control over any animals or residing in a household
2219 where animals are present; or
2320 (3) require the defendant to participate in a
2421 psychological counseling or other appropriate treatment program
2522 for a period to be determined by the court.
26- SECTION 2. The change in law made by this Act applies to a
27- defendant placed on community supervision on or after the effective
28- date of this Act, regardless of whether the offense for which the
29- defendant was placed on community supervision was committed before,
30- on, or after the effective date of this Act.
31- SECTION 3. This Act takes effect September 1, 2019.
