55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the authority of a political subdivision to regulate
88 certain activities.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Title 2, Occupations Code, is amended by adding
1111 Chapter 60 to read as follows:
1212 CHAPTER 60. PREEMPTION
1313 Sec. 60.001. PREEMPTION OF LOCAL LICENSING REQUIREMENTS.
1414 (a) In this section:
1515 (1) "Occupational license" means a license, permit,
1616 registration certificate, or other authorization that is:
1717 (A) issued by a licensing authority; and
1818 (B) required by an ordinance, rule, regulation,
1919 policy, or law for an individual to engage in an occupation.
2020 (2) "Political subdivision" means a county,
2121 municipality, special district, or other political subdivision of
2222 this state.
2323 (3) "State licensing authority" means a state agency,
2424 department, board, or commission or the executive or administrative
2525 officer of a state agency, department, board, or commission that
2626 issues an occupational license.
2727 (b) Notwithstanding any other law, if an individual is
2828 required to possess an occupational license issued by a state
2929 licensing authority to engage in an occupation, the governing body
3030 of a political subdivision may not adopt or enforce any ordinance,
3131 order, rule, regulation, law, or policy that requires the
3232 individual to:
3333 (1) possess an occupational license issued by the
3434 political subdivision to engage in that occupation; or
3535 (2) meet any other requirement or precondition to
3636 engage in that occupation.
3737 (c) An ordinance, order, rule, regulation, law, or policy
3838 that violates this section is void and unenforceable.
3939 SECTION 2. This Act takes effect September 1, 2019.
