4	10		AN ACT
5	11		relating to required notice for municipal management districts that
6	12		annex or exclude territory.
7	13		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
8	14		SECTION 1. Section 375.043, Local Government Code, is
9	15		amended to read as follows:
10	16		Sec. 375.043. ANNEXATION; NOTICE OF BOUNDARIES. (a) A
11		-	district may annex land as provided by Section 49.301 and Cha
12		-	pter
	17	+	district may annex land as provided by Section 49.301 and Chapter
13	18		54, Water Code, subject to the approval of the governing body of the
14	19		municipality.
15	20		(b) Not later than the 90th day after the date a district
16	21		annexes land under Subsection (a), the district shall provide a
17	22		description of the metes and bounds of the district, as of the date
18	23		the annexation takes effect, to each municipality that, on the date
19	24		the annexation takes effect:
20	25		(1) has territory that overlaps with the district's
21	26		territory; or
22	27		(2) is adjacent to the district.
23	28		(c) The district is not required to provide the description
24	29		of the metes and bounds required under Subsection (b) to a
25	30		municipality that has waived in writing the municipality's right to
26	31		the description.
27	32		SECTION 2. The heading to Section 375.044, Local Government
28	33		Code, is amended to read as follows:
29	34		Sec. 375.044. EXCLUDING TERRITORY; NOTICE OF BOUNDARIES.
30	35		SECTION 3. Section 375.044, Local Government Code, is
31	36		amended by adding Subsections (c) and (d) to read as follows:
32	37		(c) Not later than the 90th day after the date a district
33	38		excludes land under this section, the district shall provide a
34	39		description of the metes and bounds of the district, as of the date
35	40		the exclusion takes effect, to each municipality that, on the date
36	41		the exclusion takes effect:
37	42		(1) has territory that overlaps with the district's
38	43		territory; or
39	44		(2) is adjacent to the district.
40	45		(d) The district is not required to provide the description
41	46		of the metes and bounds required under Subsection (c) to a
42	47		municipality that has waived in writing the municipality's right to
43	48		the description.
44	49		SECTION 4. This Act takes effect September 1, 2019.
