79 relating to information regarding the procedures and available
810 resources for the sealing of juvenile records.
911 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1012 SECTION 1. Section 58.262, Family Code, is amended by
1113 amending Subsections (a) and (b) and adding Subsections (a-1),
1214 (b-1), and (e) to read as follows:
1315 (a) When a child is referred to the juvenile probation
1416 department, an employee of the juvenile probation department shall
1517 give the child and the child's parent, guardian, or custodian:
1618 (1) a written explanation describing the process of
1719 sealing records under this subchapter and a copy of this
1820 subchapter; and
1921 (2) a list of local resources that may assist the child
2022 in applying to have the child's records sealed, including attorneys
2123 who, at low or no cost, represent persons in applying for the
2224 sealing of juvenile records.
2325 (a-1) At the time an employee of the juvenile probation
2426 department gives a written explanation under Subsection (a), the
2527 employee shall additionally provide an oral explanation of the
2628 process of sealing records to the child and the child's parent,
2729 guardian, or custodian and allow any of those persons to ask
2830 questions regarding the process.
2931 (b) On the final discharge of a child, or on the last
3032 official action in the matter if there is no adjudication, a
3133 probation officer, other official at the juvenile probation
3234 department, or official at the Texas Juvenile Justice Department,
3335 as appropriate, shall give the child and the child's parent,
3436 guardian, or custodian:
3537 (1) a written explanation regarding the eligibility of
3638 the child's records for sealing under this subchapter and a copy of
3739 this subchapter; and
3840 (2) a list of local resources that may assist the child
3941 in applying to have the child's records sealed, including attorneys
4042 who, at low or no cost, represent persons in applying for the
4143 sealing of juvenile records.
4244 (b-1) At the time a probation officer, other official at the
4345 juvenile probation department, or official at the Texas Juvenile
4446 Justice Department gives a written explanation under Subsection
4547 (b), the officer or official shall additionally provide an oral
4648 explanation of the eligibility of the child's records for sealing
4749 to the child and the child's parent, guardian, or custodian and
4850 allow any of those persons to ask questions regarding the child's
4951 eligibility and the process of having records sealed.
5052 (e) The Texas Juvenile Justice Department shall publish on
5153 the department's Internet website a brochure that describes the
5254 process of sealing records under this subchapter and that lists
5355 resources that may assist a child in applying to seal the child's
5456 records.
5557 SECTION 2. Subchapter C-1, Chapter 58, Family Code, is
5658 amended by adding Section 58.2625 to read as follows:
5759 Sec. 58.2625. ONLINE DIRECTORY OF ATTORNEYS FOR SEALING
5860 JUVENILE RECORDS. (a) In this section, "state bar" means the State
5961 Bar of Texas.
6062 (b) The state bar shall create and maintain a directory of
6163 attorneys in this state who, at low or no cost, represent persons in
6264 applying for the sealing of juvenile records. The directory must
6365 describe the administrative judicial regions created under Section
6466 74.042, Government Code, and list the attorneys who offer that
6567 representation in those regions.
6668 (c) The state bar shall make the directory available to the
6769 public on the state bar's Internet website.
6870 SECTION 3. This Act takes effect September 1, 2019.
