55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the provision of information to certain women enrolled
88 in the Healthy Texas Women program.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 531, Government Code, is
1111 amended by adding Section 531.0995 to read as follows:
1212 Sec. 531.0995. INFORMATION FOR CERTAIN ENROLLEES IN THE
1313 HEALTHY TEXAS WOMEN PROGRAM. (a) In this section, "Healthy Texas
1414 Women program" means a program operated by the commission that is
1515 substantially similar to the demonstration project operated under
1616 former Section 32.0248, Human Resources Code, and that is intended
1717 to expand access to preventive health and family planning services
1818 for women in this state.
1919 (b) This section applies to a woman who is automatically
2020 enrolled in the Healthy Texas Women program following a pregnancy
2121 for which the woman received Medicaid, but who is no longer eligible
2222 to participate in Medicaid.
2323 (c) At the time a woman described by Subsection (b) is
2424 enrolled in the Healthy Texas Women program, the commission shall
2525 provide to the woman:
2626 (1) information about the Healthy Texas Women program,
2727 including the services provided under the program; and
2828 (2) a list of health care providers, including clinics
2929 and other entities, that participate in the Healthy Texas Women
3030 program and are located in the same geographical area in which the
3131 woman resides.
3232 SECTION 2. As soon as practicable after the effective date
3333 of this Act, the executive commissioner of the Health and Human
3434 Services Commission shall adopt any rules necessary to implement
3535 Section 531.0995, Government Code, as added by this Act.
3636 SECTION 3. Section 531.0995, Government Code, as added by
3737 this Act, applies only to a woman automatically enrolled in the
3838 Healthy Texas Women program on or after January 1, 2020.
3939 SECTION 4. This Act takes effect immediately if it receives
4040 a vote of two-thirds of all the members elected to each house, as
4141 provided by Section 39, Article III, Texas Constitution. If this
4242 Act does not receive the vote necessary for immediate effect, this
4343 Act takes effect September 1, 2019.
