55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to increasing the criminal punishment for the offense of
88 invasive visual recording.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 21.15(c), Penal Code, is amended to read
1111 as follows:
1212 (c) An offense under this section is a state jail felony,
1313 except that the offense is a felony of the third degree if the
1414 victim of the offense was younger than 18 years of age at the time
1515 the offense was committed, regardless of whether the actor knew the
1616 age of the victim at the time of the offense.
1717 SECTION 2. The change in law made by this Act applies only
1818 to an offense committed on or after the effective date of this Act.
1919 An offense committed before the effective date of this Act is
2020 governed by the law in effect on the date the offense was committed,
2121 and the former law is continued in effect for that purpose. For
2222 purposes of this section, an offense was committed before the
2323 effective date of this Act if any element of the offense occurred
2424 before that date.
2525 SECTION 3. This Act takes effect September 1, 2019.
