77 relating to the provision of information regarding certain
88 enforcement actions by the Texas Commission on Environmental
99 Quality.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. The heading to Section 7.003, Water Code, is
1212 amended to read as follows:
1313 Sec. 7.003. ENFORCEMENT REPORT AND STATUS MEETINGS.
1414 SECTION 2. Section 7.003, Water Code, is amended by adding
1515 Subsections (d) and (e) to read as follows:
1616 (d) The commission shall publish each report required under
1717 Subsection (a) on the commission's Internet website not later than
1818 the 15th day before the date of a meeting of the commission for
1919 which public notice is given.
2020 (e) This subsection applies to an enforcement action for
2121 which a decision or order of the commission has become final as
2222 provided by Section 2001.144, Government Code, and that involves a
2323 violation of Chapter 361, Health and Safety Code, by or at a
2424 municipal solid waste facility. On the request of a state senator
2525 or state representative, the commission quarterly shall conduct in
2626 the county in which the facility that is the subject of the
2727 enforcement action is located a public informational meeting
2828 regarding the status of the enforcement action. A representative
2929 of the facility that is the subject of the enforcement action must
3030 attend a meeting held under this subsection and must make a
3131 reasonable effort to respond to questions relevant to the
3232 enforcement action at the meeting. The commission shall post
3333 notice of the meeting on the commission's Internet website and
3434 publish the notice once a week for two consecutive weeks before the
3535 meeting in one or more newspapers having general circulation in the
3636 county in which the meeting will be held. The notice must state the
3737 time, location, and subject matter of the meeting. The owner of the
3838 facility that is the subject of the enforcement action must
3939 reimburse the commission for the cost of publishing notice under
4040 this section.
4141 SECTION 3. This Act takes effect September 1, 2019.
