66 AN ACT
77 relating to the regulation of migrant labor housing facilities;
88 changing the amount of a civil penalty.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter LL, Chapter 2306, Government Code, is
1111 amended by amending Section 2306.933 and adding Sections 2306.934
1212 and 2306.935 to read as follows:
1313 Sec. 2306.933. CIVIL PENALTY. (a) A person who violates
1414 this subchapter or a rule adopted under this subchapter is subject
1515 to a civil penalty of not less than $50 for each person occupying
1616 the migrant labor housing facility in violation of this subchapter
1717 [$200] for each day that the violation occurs.
1818 (b) An [The county attorney for the county in which the
1919 violation occurred, or the attorney general, at the request of the
2020 department, shall bring an] action [in the name of the state] to
2121 collect a [the] penalty under this section may be brought by:
2222 (1) the department through the contested case hearing
2323 process described by Section 2306.930(b);
2424 (2) the county attorney for the county in which the
2525 violation occurred, or the attorney general, at the request of the
2626 department; or
2727 (3) a migrant agricultural worker who, at the time of
2828 the violation, lived in the migrant labor housing facility that is
2929 the subject of the violation.
3030 (c) The department by rule shall adopt a penalty schedule
3131 that increases the amount of the penalty assessed against a person
3232 who repeatedly violates this subchapter or rules adopted under this
3333 subchapter.
3434 (d) A penalty collected under Subsection (b)(1) or (2) shall
3535 be deposited to the credit of the general revenue fund and may be
3636 appropriated only to the department for the enforcement of this
3737 subchapter.
3838 Sec. 2306.934. RETALIATION PROHIBITED. A person who owns,
3939 establishes, maintains, operates, or otherwise provides a migrant
4040 labor housing facility, a person who employs a migrant agricultural
4141 worker who occupies a migrant labor housing facility, or a farm
4242 labor contractor may not retaliate against a person for filing a
4343 complaint or providing information in good faith relating to a
4444 possible violation of this subchapter.
4545 Sec. 2306.935. ATTORNEY'S FEES. The court in a suit brought
4646 under this subchapter may award reasonable attorney's fees to the
4747 prevailing party.
4848 SECTION 2. Not later than March 1, 2020, the Texas
4949 Department of Housing and Community Affairs shall adopt the rules
5050 necessary to implement Subchapter LL, Chapter 2306, Government
5151 Code, as amended by this Act.
5252 SECTION 3. The change in law made by this Act in amending
5353 Section 2306.933, Government Code, and adding Section 2306.935,
5454 Government Code, applies only to a violation that occurs on or after
5555 the effective date of this Act. A violation that occurs before the
5656 effective date of this Act is governed by the law in effect on the
5757 date the violation occurred, and the former law is continued in
5858 effect for that purpose. For purposes of this section, a violation
5959 occurs before the effective date of this Act if any element of the
6060 violation occurs before that date.
6161 SECTION 4. This Act takes effect September 1, 2019.
