| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Sections 2154.202(g) and (h), Occupations Code, |
|---|
| 11 | 11 | | are amended to read as follows: |
|---|
| 12 | 12 | | (g) Except as provided by Subsection (h), a retail fireworks |
|---|
| 13 | 13 | | permit holder may sell fireworks only to the public, and only during |
|---|
| 14 | 14 | | periods: |
|---|
| 15 | 15 | | (1) beginning June 24 and ending at midnight on July 4; |
|---|
| 16 | 16 | | (2) beginning December 20 and ending at midnight on |
|---|
| 17 | 17 | | January 1 of the following year; |
|---|
| 18 | 18 | | (3) beginning February 25 and ending at midnight on |
|---|
| 19 | 19 | | March 2; |
|---|
| 20 | 20 | | (4) beginning April 16 and ending at midnight on April |
|---|
| 21 | 21 | | 21; and |
|---|
| 22 | 22 | | (5) [(3)] beginning May 1 and ending at midnight on |
|---|
| 23 | 23 | | May 5 [if the fireworks are sold at a location that is not more than |
|---|
| 24 | 24 | | 100 miles from the Texas-Mexico border and that is in a county in |
|---|
| 25 | 25 | | which the commissioners court of the county has approved the sale of |
|---|
| 26 | 26 | | fireworks during the period]. |

| 27 | 27 | | (h) In addition to the periods during which the sale of |
|---|
| 28 | 28 | | fireworks is authorized under Subsection (g), the commissioners |
|---|
| 29 | 29 | | court of a county by order may allow a retail fireworks permit |
|---|
| 30 | 30 | | holder to sell fireworks in that county only to the public and only |
|---|
| 31 | 31 | | during the period [one or more of the following periods: |
|---|
| 32 | 32 | | [(1) beginning February 25 and ending at midnight on |
|---|
| 33 | 33 | | March 2; |
|---|
| 34 | 34 | | [(2) beginning April 16 and ending at midnight on |
|---|
| 35 | 35 | | April 21; and |
|---|
| 36 | 36 | | [(3)] beginning the Wednesday before the last Monday |

| 37 | 37 | | in May and ending at midnight on the last Monday in May. |

| 38 | 38 | | SECTION 2. This Act takes effect September 1, 2019. |
