9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 247.026, Health and Safety Code, is | |
11 | 11 | amended by adding Subsections (j) and (k) to read as follows: | |
12 | 12 | (j) The executive commissioner shall require each assisted | |
13 | 13 | living facility to provide educational information regarding | |
14 | 14 | influenza to each resident of the facility not later than September | |
15 | 15 | 1 of each year. The educational information must include: | |
16 | 16 | (1) the risks associated with influenza; | |
17 | 17 | (2) the latest influenza vaccination recommendations | |
18 | 18 | of the Advisory Committee on Immunization Practices of the federal | |
19 | 19 | Centers for Disease Control and Prevention; | |
20 | 20 | (3) the availability, effectiveness, and known | |
21 | 21 | contraindications of the influenza vaccine; | |
22 | 22 | (4) the causes and symptoms of influenza; and | |
23 | 23 | (5) the means by which influenza is spread. | |
24 | 24 | (k) The executive commissioner may not require an assisted | |
25 | 25 | living facility to provide or pay for an influenza vaccination. | |
26 | 26 | SECTION 2. This Act takes effect September 1, 2019. |
