66 AN ACT
77 relating to influenza information for residents of assisted living
88 facilities.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 247.026, Health and Safety Code, is
1111 amended by adding Subsections (j) and (k) to read as follows:
1212 (j) The executive commissioner shall require each assisted
1313 living facility to provide educational information regarding
1414 influenza to each resident of the facility not later than September
1515 1 of each year. The educational information must include:
1616 (1) the risks associated with influenza;
1717 (2) the latest influenza vaccination recommendations
1818 of the Advisory Committee on Immunization Practices of the federal
1919 Centers for Disease Control and Prevention;
2020 (3) the availability, effectiveness, and known
2121 contraindications of the influenza vaccine;
2222 (4) the causes and symptoms of influenza; and
2323 (5) the means by which influenza is spread.
2424 (k) The executive commissioner may not require an assisted
2525 living facility to provide or pay for an influenza vaccination.
2626 SECTION 2. This Act takes effect September 1, 2019.
