7 | 7 | | relating to family partners, family partner peer support services, |
---|
8 | 8 | | and the provision of those services under the medical assistance |
---|
9 | 9 | | program. |
---|
10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Subchapter B, Chapter 531, Government Code, is |
---|
12 | 12 | | amended by adding Section 531.09993 to read as follows: |
---|
13 | 13 | | Sec. 531.09993. FAMILY PARTNERS. (a) With input from |
---|
14 | 14 | | family partners and the work group described by Subsection (b), the |
---|
15 | 15 | | commission shall develop and the executive commissioner shall |
---|
16 | 16 | | adopt: |
---|
17 | 17 | | (1) rules that establish training requirements for |
---|
18 | 18 | | family partners so that they are able to provide family partner peer |
---|
19 | 19 | | support services to families or primary caregivers of children with |
---|
20 | 20 | | a mental health disorder; |
---|
21 | 21 | | (2) rules that establish certification and |
---|
22 | 22 | | supervision requirements for family partners; |
---|
23 | 23 | | (3) rules that define the scope of services that |
---|
24 | 24 | | family partners may provide; and |
---|
25 | 25 | | (4) rules that distinguish family partner peer support |
---|
26 | 26 | | services from other services that a person must hold a license to |
---|
27 | 27 | | provide. |
---|
28 | 28 | | (b) The commission shall establish a stakeholder work group |
---|
29 | 29 | | to provide input for the adoption of rules under Subsection (a). |
---|
30 | 30 | | The work group is composed of the following persons appointed by the |
---|
31 | 31 | | executive commissioner: |
---|
32 | 32 | | (1) one representative of an organization that |
---|
33 | 33 | | certifies family partners in this state; |
---|
34 | 34 | | (2) three representatives of organizations that |
---|
35 | 35 | | employ family partners; |
---|
36 | 36 | | (3) one family partner who works in an urban area; |
---|
37 | 37 | | (4) one family partner who works in a rural area; |
---|
38 | 38 | | (5) one person who trains family partners; |
---|
39 | 39 | | (6) three representatives of professional groups who |
---|
40 | 40 | | supervise family partners; |
---|
41 | 41 | | (7) to the extent possible, not more than three |
---|
42 | 42 | | persons with personal experience in being the primary caregivers of |
---|
43 | 43 | | children who received services for a mental health disorder; and |
---|
44 | 44 | | (8) any other persons considered appropriate by the |
---|
45 | 45 | | executive commissioner. |
---|
46 | 46 | | (c) The executive commissioner shall appoint one member of |
---|
47 | 47 | | the work group to serve as presiding officer. |
---|
48 | 48 | | (d) The work group shall meet once every month. |
---|
49 | 49 | | (e) The work group is automatically abolished on the |
---|
50 | 50 | | adoption of rules under Subsection (a). |
---|
51 | 51 | | SECTION 2. Section 32.024, Human Resources Code, is amended |
---|
52 | 52 | | by adding Subsection (mm) to read as follows: |
---|
53 | 53 | | (mm) The commission in its rules and standards governing the |
---|
54 | 54 | | scope of services provided under the medical assistance program |
---|
55 | 55 | | shall include family partner peer support services provided by |
---|
56 | 56 | | certified family partners as part of the treatment of children with |
---|
57 | 57 | | a serious emotional disturbance to the extent permitted by federal |
---|
58 | 58 | | law. |
---|
59 | 59 | | SECTION 3. As soon as practicable after the effective date |
---|
60 | 60 | | of this Act, the executive commissioner of the Health and Human |
---|
61 | 61 | | Services Commission shall: |
---|
62 | 62 | | (1) adopt the rules required by Section 531.09993(a), |
---|
63 | 63 | | Government Code, as added by this Act; and |
---|
64 | 64 | | (2) appoint the members of the stakeholder work group |
---|
65 | 65 | | established by Section 531.09993(b), Government Code, as added by |
---|
66 | 66 | | this Act. |
---|
67 | 67 | | SECTION 4. If before implementing any provision of this Act |
---|
68 | 68 | | a state agency determines that a waiver or authorization from a |
---|
69 | 69 | | federal agency is necessary for implementation of that provision, |
---|
70 | 70 | | the agency affected by the provision shall request the waiver or |
---|
71 | 71 | | authorization and may delay implementing that provision until the |
---|
72 | 72 | | waiver or authorization is granted. |
---|
73 | 73 | | SECTION 5. This Act takes effect immediately if it receives |
---|
74 | 74 | | a vote of two-thirds of all the members elected to each house, as |
---|
75 | 75 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
76 | 76 | | Act does not receive the vote necessary for immediate effect, this |
---|
77 | 77 | | Act takes effect September 1, 2019. |
