55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to family partners, family partner peer support services,
88 and the provision of those services under the medical assistance
99 program.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter B, Chapter 531, Government Code, is
1212 amended by adding Section 531.09993 to read as follows:
1313 Sec. 531.09993. FAMILY PARTNERS. (a) With input from
1414 family partners and the work group described by Subsection (b), the
1515 commission shall develop and the executive commissioner shall
1616 adopt:
1717 (1) rules that establish training requirements for
1818 family partners so that they are able to provide family partner peer
1919 support services to families or primary caregivers of children with
2020 a mental health disorder;
2121 (2) rules that establish certification and
2222 supervision requirements for family partners;
2323 (3) rules that define the scope of services that
2424 family partners may provide; and
2525 (4) rules that distinguish family partner peer support
2626 services from other services that a person must hold a license to
2727 provide.
2828 (b) The commission shall establish a stakeholder work group
2929 to provide input for the adoption of rules under Subsection (a).
3030 The work group is composed of the following persons appointed by the
3131 executive commissioner:
3232 (1) one representative of an organization that
3333 certifies family partners in this state;
3434 (2) three representatives of organizations that
3535 employ family partners;
3636 (3) one family partner who works in an urban area;
3737 (4) one family partner who works in a rural area;
3838 (5) one person who trains family partners;
3939 (6) three representatives of professional groups who
4040 supervise family partners;
4141 (7) to the extent possible, not more than three
4242 persons with personal experience in being the primary caregivers of
4343 children who received services for a mental health disorder; and
4444 (8) any other persons considered appropriate by the
4545 executive commissioner.
4646 (c) The executive commissioner shall appoint one member of
4747 the work group to serve as presiding officer.
4848 (d) The work group shall meet once every month.
4949 (e) The work group is automatically abolished on the
5050 adoption of rules under Subsection (a).
5151 SECTION 2. Section 32.024, Human Resources Code, is amended
5252 by adding Subsection (mm) to read as follows:
5353 (mm) The commission in its rules and standards governing the
5454 scope of services provided under the medical assistance program
5555 shall include family partner peer support services provided by
5656 certified family partners as part of the treatment of children with
5757 a serious emotional disturbance to the extent permitted by federal
5858 law.
5959 SECTION 3. As soon as practicable after the effective date
6060 of this Act, the executive commissioner of the Health and Human
6161 Services Commission shall:
6262 (1) adopt the rules required by Section 531.09993(a),
6363 Government Code, as added by this Act; and
6464 (2) appoint the members of the stakeholder work group
6565 established by Section 531.09993(b), Government Code, as added by
6666 this Act.
6767 SECTION 4. If before implementing any provision of this Act
6868 a state agency determines that a waiver or authorization from a
6969 federal agency is necessary for implementation of that provision,
7070 the agency affected by the provision shall request the waiver or
7171 authorization and may delay implementing that provision until the
7272 waiver or authorization is granted.
7373 SECTION 5. This Act takes effect immediately if it receives
7474 a vote of two-thirds of all the members elected to each house, as
7575 provided by Section 39, Article III, Texas Constitution. If this
7676 Act does not receive the vote necessary for immediate effect, this
7777 Act takes effect September 1, 2019.
