79 relating to the use of promotoras and community health workers in
810 Medicaid managed care.
911 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1012 SECTION 1. Subchapter A, Chapter 533, Government Code, is
1113 amended by adding Section 533.032 to read as follows:
1214 Sec. 533.032. PROMOTORAS AND COMMUNITY HEALTH WORKERS. (a)
1315 In this section, "promotora" and "community health worker" have the
1416 meaning assigned by Section 48.001, Health and Safety Code.
1517 (b) The commission shall allow each managed care
1618 organization that contracts with the commission to provide health
1719 care services to recipients under the STAR Medicaid managed care
1820 program to categorize services provided by a promotora or community
1921 health worker as a quality improvement cost, as authorized by
2022 federal law, instead of as an administrative expense.
2123 SECTION 2. If before implementing any provision of this Act
2224 a state agency determines that a waiver or authorization from a
2325 federal agency is necessary for implementation of that provision,
2426 the agency affected by the provision shall request the waiver or
2527 authorization and may delay implementing that provision until the
2628 waiver or authorization is granted.
2729 SECTION 3. This Act takes effect immediately if it receives
2830 a vote of two-thirds of all the members elected to each house, as
2931 provided by Section 39, Article III, Texas Constitution. If this
3032 Act does not receive the vote necessary for immediate effect, this
3133 Act takes effect September 1, 2019.
