| 7 | 7 | | relating to the service retirement annuity for certain members of |

| 8 | 8 | | the Judicial Retirement System of Texas Plan Two. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 839.102, Government Code, is amended by |
|---|
| 11 | 11 | | adding Subsection (b-1) to read as follows: |
|---|
| 12 | 12 | | (b-1) If a member who is otherwise eligible to retire under |
|---|
| 13 | 13 | | Section 839.101 retires because the member is required to vacate |
|---|
| 14 | 14 | | the member's judicial office under Section 1-a(1), Article V, Texas |
|---|
| 15 | 15 | | Constitution, the applicable state salary under Subsection (a) or |
|---|
| 16 | 16 | | (c) includes any increase in the state salary authorized by |
|---|
| 17 | 17 | | legislation that takes effect on or before the one year anniversary |
|---|
| 18 | 18 | | of the member's effective date of retirement. The retirement |
|---|
| 19 | 19 | | system shall recompute the annuity of a person subject to this |
|---|
| 20 | 20 | | subsection and the recomputed annuity becomes payable beginning |
|---|
| 21 | 21 | | with the first annuity payable on or after the date the increase in |
|---|
| 22 | 22 | | the applicable state salary takes effect. |
|---|
| 23 | 23 | | SECTION 2. Section 839.102(b-1), Government Code, as added |
|---|
| 24 | 24 | | by this Act, applies only to a benefit payment made by the Judicial |
|---|
| 25 | 25 | | Retirement System of Texas Plan Two on or after the effective date |
|---|
| 26 | 26 | | of this Act. |
|---|
| 27 | 27 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 28 | 28 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 29 | 29 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 30 | 30 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 31 | 31 | | Act takes effect September 1, 2019. |
