55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the submission by telephonic facsimile or electronic
88 transmission of an application for a ballot to be voted by mail.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 84.007(b), Election Code, is amended to
1111 read as follows:
1212 (b) An application must be submitted to the early voting
1313 clerk by:
1414 (1) mail;
1515 (2) common or contract carrier;
1616 (3) [subject to Subsection (b-1),] telephonic
1717 facsimile machine, if a machine is available in the clerk's office;
1818 or
1919 (4) [subject to Subsection (b-1),] electronic
2020 transmission of a scanned application containing an original
2121 signature.
2222 SECTION 2. Section 84.007(b-1), Election Code, is repealed.
2323 SECTION 3. The change in law made by this Act applies only
2424 to an application for a ballot to be voted by mail submitted on or
2525 after the effective date of this Act. An application for a ballot
2626 to be voted by mail submitted before the effective date of this Act
2727 is governed by the law in effect when the application was submitted,
2828 and the former law is continued in effect for that purpose.
2929 SECTION 4. This Act takes effect September 1, 2019.
