| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Subchapter B, Chapter 56, Utilities Code, is |
|---|
| 10 | 10 | | amended by adding Section 56.0225 to read as follows: |
|---|
| 11 | 11 | | Sec. 56.0225. FOUNDATION SCHOOL FUND SURCHARGE. (a) Each |
|---|
| 12 | 12 | | telecommunications provider that pays the uniform charge under |
|---|
| 13 | 13 | | Section 56.022 shall pay a surcharge of 10 cents per month for each |
|---|
| 14 | 14 | | customer the telecommunications provider bills for the uniform |
|---|
| 15 | 15 | | charge. |
|---|
| 16 | 16 | | (b) A telecommunications provider shall pay the surcharge |
|---|
| 17 | 17 | | in accordance with procedures approved by the commission. |
|---|
| 18 | 18 | | (c) The commission shall ensure that revenue from the |
|---|
| 19 | 19 | | surcharge is remitted to the comptroller for deposit to the credit |
|---|
| 20 | 20 | | of the foundation school fund. |
|---|
| 21 | 21 | | SECTION 2. The Public Utility Commission of Texas shall |
|---|
| 22 | 22 | | adopt any rules necessary to implement Section 56.0225, Utilities |
|---|
| 23 | 23 | | Code, as added by this Act, as soon as possible after the effective |
|---|
| 24 | 24 | | date of this Act. A telecommunications provider to which Section |
|---|
| 25 | 25 | | 56.0225, Utilities Code, as added by this Act, applies is not |
|---|
| 26 | 26 | | required to pay the surcharge required by that section until |
|---|
| 27 | 27 | | required by a rule of the Public Utility Commission of Texas. |
|---|
| 28 | 28 | | SECTION 3. This Act takes effect September 1, 2019. |
