| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Article 26.044(l), Code of Criminal Procedure, | |
| 11 | 11 | is amended to read as follows: | |
| 12 | 12 | (l) A public defender's office may investigate the | |
| 13 | 13 | financial condition of any person the public defender's office is | |
| 14 | 14 | appointed to represent. [The public defender's office shall report | |
| 15 | 15 | the results of the investigation to the appointing judge. The judge | |
| 16 | 16 | may hold a hearing to determine if the person is indigent and | |
| 17 | 17 | entitled to representation under this article.] | |
| 18 | 18 | SECTION 2. This Act takes effect September 1, 2019. |
