55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the requirement that the comptroller of public accounts
88 receive copies of orders adopted in connection with the
99 administration of elections.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 12.032(b), Election Code, is amended to
1212 read as follows:
1313 (b) The county clerk shall deliver a certified copy of the
1414 order to the secretary of state [and comptroller of public
1515 accounts] not later than the third day after the date the order is
1616 adopted.
1717 SECTION 2. Section 12.034(b), Election Code, is amended to
1818 read as follows:
1919 (b) Not later than the third day after the date the
2020 rescission order is adopted, the county clerk shall deliver a
2121 certified copy of the order to the secretary of state [and
2222 comptroller of public accounts].
2323 SECTION 3. Section 31.031(d), Election Code, is amended to
2424 read as follows:
2525 (d) Not later than the third day after the date the order is
2626 adopted, the county clerk shall deliver a certified copy of the
2727 order to:
2828 (1) the secretary of state; and
2929 (2) [the comptroller of public accounts; and
3030 [(3)] each member of the county election commission.
3131 SECTION 4. Section 31.048(c), Election Code, is amended to
3232 read as follows:
3333 (c) Not later than the third day after the date an order
3434 abolishing the position of administrator is adopted, the county
3535 clerk shall deliver a certified copy of the order to the secretary
3636 of state [and comptroller of public accounts].
3737 SECTION 5. Section 31.071(c), Election Code, is amended to
3838 read as follows:
3939 (c) Not later than the third day after the date the order is
4040 adopted, the county clerk shall deliver a certified copy of the
4141 order to the secretary of state [and comptroller of public
4242 accounts].
4343 SECTION 6. Section 31.076(b), Election Code, is amended to
4444 read as follows:
4545 (b) Not later than the third day after the date the
4646 rescission order is adopted, the county clerk shall deliver a
4747 certified copy of the order to the secretary of state [and
4848 comptroller of public accounts].
4949 SECTION 7. Section 31.152(h), Election Code, is amended to
5050 read as follows:
5151 (h) Not later than the third day after the date the order is
5252 adopted, the chair of the joint elections commission shall deliver
5353 a certified copy of the order to:
5454 (1) the secretary of state;
5555 (2) [the comptroller;
5656 [(3)] each member of the county election commission, if
5757 any; and
5858 (3) [(4)] a representative from each participating
5959 entity.
6060 SECTION 8. Section 31.170(c), Election Code, is amended to
6161 read as follows:
6262 (c) Not later than the third day after the date an order
6363 abolishing the position of joint elections administrator is
6464 adopted, the county clerk of the most populous participating county
6565 shall deliver a certified copy of the order to the secretary of
6666 state [and comptroller].
6767 SECTION 9. The changes in law made by this Act apply only to
6868 an order adopted on or after the effective date of this Act. An
6969 order adopted before the effective date of this Act is governed by
7070 the law in effect on the date the order was adopted, and the former
7171 law is continued in effect for that purpose.
7272 SECTION 10. This Act takes effect September 1, 2019.
