55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to public access to certain hospital inspection and
88 investigation information and materials.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 241.051(d), Health and Safety Code, is
1111 amended to read as follows:
1212 (d) Information [All information and materials] obtained or
1313 compiled by the commission [department] in connection with a
1414 complaint or [and] investigation that is [concerning a hospital
1515 are] confidential by law, such as individually identifiable
1616 information concerning a patient or health care professional, is
1717 [and] not subject to disclosure under Chapter 552 [Section 552.001
1818 et seq.], Government Code[, and not subject to disclosure,
1919 discovery, subpoena, or other means of legal compulsion for their
2020 release to anyone other than the department or its employees or
2121 agents involved in the enforcement action except that this
2222 information may be disclosed to:
2323 [(1) persons involved with the department in the
2424 enforcement action against the hospital;
2525 [(2) the hospital that is the subject of the
2626 enforcement action, or the hospital's authorized representative;
2727 [(3) appropriate state or federal agencies that are
2828 authorized to inspect, survey, or investigate hospital services;
2929 [(4) law enforcement agencies; and
3030 [(5) persons engaged in bona fide research, if all
3131 individual-identifying and hospital-identifying information has
3232 been deleted].
3333 SECTION 2. Section 577.013(d), Health and Safety Code, is
3434 amended to read as follows:
3535 (d) Information [All information and materials] obtained or
3636 compiled by the commission [department] in connection with a
3737 complaint or [and] investigation that is [concerning a mental
3838 hospital licensed under this chapter are] confidential by law, such
3939 as individually identifiable information concerning a patient or
4040 health care professional, is [and] not subject to disclosure under
4141 Chapter 552, Government Code [, discovery, subpoena, or other means
4242 of legal compulsion for their release to anyone other than the
4343 department or its employees or agents involved in the enforcement
4444 action except that this information may be disclosed to:
4545 [(1) persons involved with the department in the
4646 enforcement action against the licensed mental hospital;
4747 [(2) the licensed mental hospital that is the subject
4848 of the enforcement action, or the licensed mental hospital's
4949 authorized representative;
5050 [(3) appropriate state or federal agencies that are
5151 authorized to inspect, survey, or investigate licensed mental
5252 hospital services;
5353 [(4) law enforcement agencies; and
5454 [(5) persons engaged in bona fide research, if all
5555 individual-identifying information and information identifying the
5656 licensed mental hospital has been deleted].
5757 SECTION 3. Sections 241.051(e) and 577.013(e), Health and
5858 Safety Code, are repealed.
5959 SECTION 4. This Act takes effect September 1, 2019.
