55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to an annual adjustment to the basic allotment under the
88 Foundation School Program to reflect inflation.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 42.101, Education Code, is amended by
1111 amending Subsection (a) and adding Subsection (a-3) to read as
1212 follows:
1313 (a) Subject to adjustment under Subsection (a-3), for [For]
1414 each student in average daily attendance, not including the time
1515 students spend each day in special education programs in an
1616 instructional arrangement other than mainstream or career and
1717 technology education programs, for which an additional allotment is
1818 made under Subchapter C, a district is entitled to an allotment
1919 equal to the lesser of $4,765 or the amount that results from the
2020 following formula:
2121 A = $4,765 X (DCR/MCR)
2222 where:
2323 "A" is the allotment to which a district is entitled;
2424 "DCR" is the district's compressed tax rate, which is the
2525 product of the state compression percentage, as determined under
2626 Section 42.2516, multiplied by the maintenance and operations tax
2727 rate adopted by the district for the 2005 tax year; and
2828 "MCR" is the state maximum compressed tax rate, which is the
2929 product of the state compression percentage, as determined under
3030 Section 42.2516, multiplied by $1.50.
3131 (a-3) Beginning with the 2021-2022 school year, the basic
3232 allotment provided to a district under Subsection (a) or (b) is
3333 adjusted annually to increase the allotment by the greater of:
3434 (1) one percent of the amount of the allotment for the
3535 preceding school year; or
3636 (2) the amount that results from applying the
3737 inflation rate, as determined by the comptroller on the basis of
3838 changes in the Consumer Price Index for All Urban Consumers
3939 published by the Bureau of Labor Statistics of the United States
4040 Department of Labor, to the allotment for the preceding school
4141 year.
4242 SECTION 2. This Act takes effect September 1, 2019.
