78 AN ACT
89 relating to a trauma history screening for certain defendants and
910 inmates.
1011 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1112 SECTION 1. Subchapter B, Chapter 501, Government Code, is
1213 amended by adding Section 501.070 to read as follows:
1314 Sec. 501.070. TRAUMA HISTORY SCREENING. The department
1415 shall:
1516 (1) screen each inmate during the diagnostic process
1617 to determine whether the inmate has experienced adverse childhood
1718 experiences or other significant trauma; and
1819 (2) refer any inmate exhibiting symptoms of
1920 post-traumatic stress disorder or other symptoms of trauma as
2021 needed to the appropriate medical or mental health care
2122 professional for treatment.
2223 SECTION 2. Chapter 509, Government Code, is amended by
2324 adding Section 509.0042 to read as follows:
2425 Sec. 509.0042. TRAUMA HISTORY SCREENING. The division
2526 shall require each department to:
2627 (1) screen each defendant at the time of the
2728 defendant's initial placement on community supervision to
2829 determine whether the defendant has experienced adverse childhood
2930 experiences or other significant trauma; and
3031 (2) refer any defendant exhibiting symptoms of
3132 post-traumatic stress disorder or other symptoms of trauma as
3233 needed to the appropriate medical or mental health care
3334 professional for treatment.
3435 SECTION 3. This Act takes effect September 1, 2019.
