7 | 7 | | relating to grounds for refusal of certain alcoholic beverage |
---|
8 | 8 | | licenses and permits. |
---|
9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 11.44(b), Alcoholic Beverage Code, is |
---|
11 | 11 | | amended to read as follows: |
---|
12 | 12 | | (b) The commission or administrator shall refuse to issue |
---|
13 | 13 | | for a period of three years a permit or license for any location to |
---|
14 | 14 | | an applicant who submitted a prior application that expired or was |
---|
15 | 15 | | voluntarily surrendered before the hearing on the application was |
---|
16 | 16 | | held on a protest involving allegations of prostitution, a |
---|
17 | 17 | | shooting, stabbing, or other violent act, or an offense involving |
---|
18 | 18 | | drugs, [or] trafficking of persons, or drink solicitation as |
---|
19 | 19 | | described by Section 104.01. The three-year period commences on |
---|
20 | 20 | | the date the prior application expired or was voluntarily |
---|
21 | 21 | | surrendered. |
---|
22 | 22 | | SECTION 2. Section 11.46(c), Alcoholic Beverage Code, is |
---|
23 | 23 | | amended to read as follows: |
---|
24 | 24 | | (c) The commission or administrator shall refuse to issue |
---|
25 | 25 | | for a period of one year after cancellation a mixed beverage permit |
---|
26 | 26 | | or private club registration permit for a premises where a license |
---|
27 | 27 | | or permit has been canceled during the preceding 12 months as a |
---|
28 | 28 | | result of: |
---|
29 | 29 | | (1) a shooting, stabbing, or other violent act; [,] or |
---|
30 | 30 | | (2) [as a result of] an offense involving drugs, |
---|
31 | 31 | | prostitution, [or] trafficking of persons, or drink solicitation as |
---|
32 | 32 | | described by Section 104.01. |
---|
33 | 33 | | SECTION 3. Section 61.42(c), Alcoholic Beverage Code, is |
---|
34 | 34 | | amended to read as follows: |
---|
35 | 35 | | (c) The county judge, commission, or administrator shall |
---|
36 | 36 | | refuse to approve or issue for a period of one year a retail |
---|
37 | 37 | | dealer's on-premise license or a wine and beer retailer's permit for |
---|
38 | 38 | | a premises where a license or permit has been canceled during the |
---|
39 | 39 | | preceding 12 months as a result of: |
---|
40 | 40 | | (1) a shooting, stabbing, or other violent act; [,] or |
---|
41 | 41 | | (2) [as a result of] an offense involving drugs, |
---|
42 | 42 | | prostitution, [or] trafficking of persons, or drink solicitation as |
---|
43 | 43 | | described by Section 104.01. |
---|
44 | 44 | | SECTION 4. Sections 11.44(b), 11.46(c), and 61.42(c), |
---|
45 | 45 | | Alcoholic Beverage Code, as amended by this Act, apply to an |
---|
46 | 46 | | application for an alcoholic beverage permit or license filed on or |
---|
47 | 47 | | after the effective date of this Act or pending on the effective |
---|
48 | 48 | | date of this Act. |
---|
49 | 49 | | SECTION 5. This Act takes effect September 1, 2019. |
