55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the threshold contract amount at which a county is
88 required to engage in a competitive purchasing procedure for
99 certain purchases.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Sections 252.312(b) and (c), Transportation
1212 Code, are amended to read as follows:
1313 (b) If the county road engineer so recommends and the
1414 commissioners court considers it to be in the best interest of the
1515 county, a purchase in an amount of $50,000 [$25,000] or less may be
1616 made through negotiation by the commissioners court or the court's
1717 authorized representative on requisition to be approved by the
1818 commissioners court or the county auditor without advertising for
1919 competitive bids.
2020 (c) A purchase may not be divided or reduced to avoid the
2121 competitive bidding requirement on a purchase that would otherwise
2222 cost more than $50,000 [$25,000].
2323 SECTION 2. The change in law made by this Act applies only
2424 to a purchase commenced on or after September 1, 2019. A purchase
2525 for which competitive bids are advertised before September 1, 2019,
2626 is governed by the law in effect on the date the bids were
2727 advertised, and that law is continued in effect for that purpose.
2828 SECTION 3. This Act takes effect September 1, 2019.
