| 10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 11 | 11 | SECTION 1. Sections 252.312(b) and (c), Transportation | |
| 12 | 12 | Code, are amended to read as follows: | |
| 13 | 13 | (b) If the county road engineer so recommends and the | |
| 14 | 14 | commissioners court considers it to be in the best interest of the | |
| 15 | 15 | county, a purchase in an amount of $50,000 [$25,000] or less may be | |
| 16 | 16 | made through negotiation by the commissioners court or the court's | |
| 17 | 17 | authorized representative on requisition to be approved by the | |
| 18 | 18 | commissioners court or the county auditor without advertising for | |
| 19 | 19 | competitive bids. | |
| 20 | 20 | (c) A purchase may not be divided or reduced to avoid the | |
| 21 | 21 | competitive bidding requirement on a purchase that would otherwise | |
| 22 | 22 | cost more than $50,000 [$25,000]. | |
| 23 | 23 | SECTION 2. The change in law made by this Act applies only | |
| 24 | 24 | to a purchase commenced on or after September 1, 2019. A purchase | |
| 25 | 25 | for which competitive bids are advertised before September 1, 2019, | |
| 26 | 26 | is governed by the law in effect on the date the bids were | |
| 27 | 27 | advertised, and that law is continued in effect for that purpose. | |
| 28 | 28 | SECTION 3. This Act takes effect September 1, 2019. |
