| 7 | 14 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 15 | | SECTION 1. Section 1051.107, Special District Local Laws |
|---|
| 9 | 16 | | Code, is amended by amending Subsection (b) and adding Subsection |
|---|
| 10 | 17 | | (b-1) to read as follows: |
|---|
| 11 | 18 | | (b) The board may lease all or part of the district's land, |
|---|
| 12 | 19 | | buildings, and [other] facilities on terms considered to be in the |
|---|
| 13 | 20 | | best interest of the district's inhabitants. The term of the lease |
|---|
| 14 | 21 | | may not exceed 50 [25] years. |
|---|
| 15 | 22 | | (b-1) A lease of the district's land to a private entity |
|---|
| 16 | 23 | | under Subsection (b) must include a provision that requires the |
|---|
| 17 | 24 | | lessee to indemnify the district for and exempt the district from |
|---|
| 18 | 25 | | any liability resulting from an act or omission of the lessee. |
|---|
| 19 | 26 | | SECTION 2. Section 1051.107(b-1), Special District Local |
|---|
| 20 | 27 | | Laws Code, as added by this Act, applies only to a contract entered |
|---|
| 21 | 28 | | into on or after the effective date of this Act. |
|---|
| 22 | 29 | | SECTION 3. This Act takes effect September 1, 2019. |
