9 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 12 | | SECTION 1. Section 42.048(f), Human Resources Code, is |
---|
11 | 13 | | amended to read as follows: |
---|
12 | 14 | | (f) A license must be issued if the commission [department] |
---|
13 | 15 | | determines that a facility meets all requirements. The evaluation |
---|
14 | 16 | | shall be based on one or more visits to the facility and a review of |
---|
15 | 17 | | required forms and records. A license is valid until [the license |
---|
16 | 18 | | expires, is] revoked[,] or [is] surrendered. |
---|
17 | 19 | | SECTION 2. Sections 42.054(a), (b), (c), (d), and (e), |
---|
18 | 20 | | Human Resources Code, are amended to read as follows: |
---|
19 | 21 | | (a) The commission [department] shall charge an applicant a |
---|
20 | 22 | | nonrefundable application fee in the amount of $35 for an initial |
---|
21 | 23 | | license to operate a child-care facility, a child-placing agency, |
---|
22 | 24 | | or a continuum-of-care residential operation. |
---|
23 | 25 | | (b) The commission [department] shall charge each |
---|
24 | 26 | | child-care facility a fee in the amount of $35 for an initial |
---|
25 | 27 | | license. The commission [department] shall charge each |
---|
26 | 28 | | child-placing agency and continuum-of-care residential operation a |
---|
27 | 29 | | fee in the amount of $50 for an initial license. |
---|
28 | 30 | | (c) The commission [department] shall charge each licensed |
---|
29 | 31 | | child-care facility an annual license fee in an amount equal to $35 |
---|
30 | 32 | | plus $1 multiplied by the maximum number of children for whom the |
---|
31 | 33 | | child-care facility is authorized to provide care. The fee is due |
---|
32 | 34 | | on the date on which the commission [department] issues the |
---|
33 | 35 | | child-care facility's initial license and on the anniversary of |
---|
34 | 36 | | that date. |
---|
35 | 37 | | (d) The commission [department] shall charge each licensed |
---|
36 | 38 | | child-placing agency and continuum-of-care residential operation |
---|
37 | 39 | | an annual license fee in the amount of $100. The fee is due on the |
---|
38 | 40 | | date on which the commission [department] issues the initial |
---|
39 | 41 | | license to the child-placing agency or continuum-of-care |
---|
40 | 42 | | residential operation and on the anniversary of that date. |
---|
41 | 43 | | (e) The commission [department] shall charge each family |
---|
42 | 44 | | home that is listed or registered with the commission [department] |
---|
43 | 45 | | an annual fee to cover a part of the commission's cost in regulating |
---|
44 | 46 | | family homes. The amount of the fee is $20 for a listed home or $35 |
---|
45 | 47 | | for a registered home. The fee is due on the date on which the |
---|
46 | 48 | | commission [department] initially lists or registers the home and |
---|
47 | 49 | | on the anniversary of that date. |
---|
48 | 50 | | SECTION 3. Sections 42.050 and 42.054(h), Human Resources |
---|
49 | 51 | | Code, are repealed. |
---|
50 | 52 | | SECTION 4. The changes in law made by this Act apply only to |
---|
51 | 53 | | an application fee paid or license fee or registration and listing |
---|
52 | 54 | | fee due on or after the effective date of this Act. An application |
---|
53 | 55 | | fee paid or license fee or registration and listing fee due before |
---|
54 | 56 | | that date is governed by the law in effect on the date the fee was |
---|
55 | 57 | | paid or due, as applicable, and that law is continued in effect for |
---|
56 | 58 | | that purpose. |
---|
57 | 59 | | SECTION 5. This Act takes effect September 1, 2019. |
