79 relating to license terms and fees and registration and listing
810 fees for certain child-care facilities.
911 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1012 SECTION 1. Section 42.048(f), Human Resources Code, is
1113 amended to read as follows:
1214 (f) A license must be issued if the commission [department]
1315 determines that a facility meets all requirements. The evaluation
1416 shall be based on one or more visits to the facility and a review of
1517 required forms and records. A license is valid until [the license
1618 expires, is] revoked[,] or [is] surrendered.
1719 SECTION 2. Sections 42.054(a), (b), (c), (d), and (e),
1820 Human Resources Code, are amended to read as follows:
1921 (a) The commission [department] shall charge an applicant a
2022 nonrefundable application fee in the amount of $35 for an initial
2123 license to operate a child-care facility, a child-placing agency,
2224 or a continuum-of-care residential operation.
2325 (b) The commission [department] shall charge each
2426 child-care facility a fee in the amount of $35 for an initial
2527 license. The commission [department] shall charge each
2628 child-placing agency and continuum-of-care residential operation a
2729 fee in the amount of $50 for an initial license.
2830 (c) The commission [department] shall charge each licensed
2931 child-care facility an annual license fee in an amount equal to $35
3032 plus $1 multiplied by the maximum number of children for whom the
3133 child-care facility is authorized to provide care. The fee is due
3234 on the date on which the commission [department] issues the
3335 child-care facility's initial license and on the anniversary of
3436 that date.
3537 (d) The commission [department] shall charge each licensed
3638 child-placing agency and continuum-of-care residential operation
3739 an annual license fee in the amount of $100. The fee is due on the
3840 date on which the commission [department] issues the initial
3941 license to the child-placing agency or continuum-of-care
4042 residential operation and on the anniversary of that date.
4143 (e) The commission [department] shall charge each family
4244 home that is listed or registered with the commission [department]
4345 an annual fee to cover a part of the commission's cost in regulating
4446 family homes. The amount of the fee is $20 for a listed home or $35
4547 for a registered home. The fee is due on the date on which the
4648 commission [department] initially lists or registers the home and
4749 on the anniversary of that date.
4850 SECTION 3. Sections 42.050 and 42.054(h), Human Resources
4951 Code, are repealed.
5052 SECTION 4. The changes in law made by this Act apply only to
5153 an application fee paid or license fee or registration and listing
5254 fee due on or after the effective date of this Act. An application
5355 fee paid or license fee or registration and listing fee due before
5456 that date is governed by the law in effect on the date the fee was
5557 paid or due, as applicable, and that law is continued in effect for
5658 that purpose.
5759 SECTION 5. This Act takes effect September 1, 2019.
