4	10		AN ACT
5	11		relating to a public school student's transition from an
6	12		alternative education program to a regular classroom.
7	13		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
8	14		SECTION 1. Subchapter A, Chapter 37, Education Code, is
9	15		amended by adding Section 37.023 to read as follows:
10	16		Sec. 37.023. TRANSITION FROM ALTERNATIVE EDUCATION PROGRAM
11	17		TO REGULAR CLASSROOM. (a) In this section:
12	18		(1) "Alternative education program" includes:
13	19		(A) a disciplinary alternative education program
14	20		operated by a school district or open-enrollment charter school;
15	21		(B) a juvenile justice alternative education
16	22		program; and
17	23		(C) a residential program or facility operated by
18	24		or under contract with the Texas Juvenile Justice Department, a
19	25		juvenile board, or any other governmental entity.
20	26		(2) "Licensed clinical social worker" has the meaning
21	27		assigned by Section 505.002, Occupations Code.
22	28		(b) As soon as practicable after an alternative education
23	29		program determines the date of a student's release from the
24	30		program, the alternative education program administrator shall:
25	31		(1) provide written notice of that date to:
26	32		(A) the student's parent or a person standing in
27	33		parental relation to the student; and
28	34		(B) the administrator of the campus to which the
29	35		student intends to transition; and
30	36		(2) provide the campus administrator:
31	37		(A) an assessment of the student's academic
32	38		growth while attending the alternative education program; and
33	39		(B) the results of any assessment instruments
34	40		administered to the student.
35	41		(c) Not later than five instructional days after the date of
36	42		a student's release from an alternative education program, the
37	43		campus administrator shall coordinate the student's transition to a
38	44		regular classroom. The coordination must include assistance and
39	45		recommendations from:
40	46		(1) school counselors;
41	47		(2) school district peace officers;
42	48		(3) school resource officers;
43	49		(4) licensed clinical social workers;
44	50		(5) campus behavior coordinators;
45	51		(6) classroom teachers who are or may be responsible
46	52		for implementing the student's personalized transition plan
47	53		developed under Subsection (d); and
48	54		(7) any other appropriate school district personnel.
49	55		(d) The assistance required by Subsection (c) must include a
50	56		personalized transition plan for the student developed by the
51	57		campus administrator. A personalized transition plan:
52	58		(1) must include recommendations for the best
53	59		educational placement of the student; and
54	60		(2) may include:
55	61		(A) recommendations for counseling, behavioral
56	62		management, or academic assistance for the student with a
57	63		concentration on the student's academic or career goals;
58	64		(B) recommendations for assistance for obtaining
59	65		access to mental health services provided by the district or
60	66		school, a local mental health authority, or another private or
61	67		public entity;
62	68		(C) the provision of information to the student's
63	69		parent or a person standing in parental relation to the student
64	70		about the process to request a full individual and initial
65	71		evaluation of the student for purposes of special education
66	72		services under Section 29.004; and
67	73		(D) a regular review of the student's progress
68	74		toward the student's academic or career goals.
69	75		(e) If practicable, the campus administrator, or the
70	76		administrator's designee, shall meet with the student's parent or a
71	77		person standing in parental relation to the student to coordinate
72	78		plans for the student's transition.
73	79		(f) This section applies only to a student subject to
74	80		compulsory attendance requirements under Section 25.085.
75	81		SECTION 2. This Act applies beginning with the 2019-2020
76	82		school year.
77	83		SECTION 3. This Act takes effect immediately if it receives
78	84		a vote of two-thirds of all the members elected to each house, as
79	85		provided by Section 39, Article III, Texas Constitution. If this
80	86		Act does not receive the vote necessary for immediate effect, this
81	87		Act takes effect September 1, 2019.
