410 AN ACT
511 relating to a public school student's transition from an
612 alternative education program to a regular classroom.
713 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
814 SECTION 1. Subchapter A, Chapter 37, Education Code, is
915 amended by adding Section 37.023 to read as follows:
1016 Sec. 37.023. TRANSITION FROM ALTERNATIVE EDUCATION PROGRAM
1117 TO REGULAR CLASSROOM. (a) In this section:
1218 (1) "Alternative education program" includes:
1319 (A) a disciplinary alternative education program
1420 operated by a school district or open-enrollment charter school;
1521 (B) a juvenile justice alternative education
1622 program; and
1723 (C) a residential program or facility operated by
1824 or under contract with the Texas Juvenile Justice Department, a
1925 juvenile board, or any other governmental entity.
2026 (2) "Licensed clinical social worker" has the meaning
2127 assigned by Section 505.002, Occupations Code.
2228 (b) As soon as practicable after an alternative education
2329 program determines the date of a student's release from the
2430 program, the alternative education program administrator shall:
2531 (1) provide written notice of that date to:
2632 (A) the student's parent or a person standing in
2733 parental relation to the student; and
2834 (B) the administrator of the campus to which the
2935 student intends to transition; and
3036 (2) provide the campus administrator:
3137 (A) an assessment of the student's academic
3238 growth while attending the alternative education program; and
3339 (B) the results of any assessment instruments
3440 administered to the student.
3541 (c) Not later than five instructional days after the date of
3642 a student's release from an alternative education program, the
3743 campus administrator shall coordinate the student's transition to a
3844 regular classroom. The coordination must include assistance and
3945 recommendations from:
4046 (1) school counselors;
4147 (2) school district peace officers;
4248 (3) school resource officers;
4349 (4) licensed clinical social workers;
4450 (5) campus behavior coordinators;
4551 (6) classroom teachers who are or may be responsible
4652 for implementing the student's personalized transition plan
4753 developed under Subsection (d); and
4854 (7) any other appropriate school district personnel.
4955 (d) The assistance required by Subsection (c) must include a
5056 personalized transition plan for the student developed by the
5157 campus administrator. A personalized transition plan:
5258 (1) must include recommendations for the best
5359 educational placement of the student; and
5460 (2) may include:
5561 (A) recommendations for counseling, behavioral
5662 management, or academic assistance for the student with a
5763 concentration on the student's academic or career goals;
5864 (B) recommendations for assistance for obtaining
5965 access to mental health services provided by the district or
6066 school, a local mental health authority, or another private or
6167 public entity;
6268 (C) the provision of information to the student's
6369 parent or a person standing in parental relation to the student
6470 about the process to request a full individual and initial
6571 evaluation of the student for purposes of special education
6672 services under Section 29.004; and
6773 (D) a regular review of the student's progress
6874 toward the student's academic or career goals.
6975 (e) If practicable, the campus administrator, or the
7076 administrator's designee, shall meet with the student's parent or a
7177 person standing in parental relation to the student to coordinate
7278 plans for the student's transition.
7379 (f) This section applies only to a student subject to
7480 compulsory attendance requirements under Section 25.085.
7581 SECTION 2. This Act applies beginning with the 2019-2020
7682 school year.
7783 SECTION 3. This Act takes effect immediately if it receives
7884 a vote of two-thirds of all the members elected to each house, as
7985 provided by Section 39, Article III, Texas Constitution. If this
8086 Act does not receive the vote necessary for immediate effect, this
8187 Act takes effect September 1, 2019.
