7 | 7 | | relating to requirements regarding a municipality's comprehensive |
---|
8 | 8 | | plan for long-range development, including adoption of an |
---|
9 | 9 | | environmental report. |
---|
10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Section 213.003, Local Government Code, is |
---|
12 | 12 | | amended by amending Subsection (a) and adding Subsection (c) to |
---|
13 | 13 | | read as follows: |
---|
14 | 14 | | (a) A comprehensive plan may be adopted or amended only by |
---|
15 | 15 | | ordinance following: |
---|
16 | 16 | | (1) a hearing at which the public is given the |
---|
17 | 17 | | opportunity to give testimony and present written evidence; and |
---|
18 | 18 | | (2) review by the municipality's planning commission |
---|
19 | 19 | | or department, if one exists. |
---|
20 | 20 | | (c) The governing body of a municipality that has adopted a |
---|
21 | 21 | | comprehensive plan shall update the plan at least every five years. |
---|
22 | 22 | | SECTION 2. Chapter 213, Local Government Code, is amended |
---|
23 | 23 | | by adding Section 213.006 to read as follows: |
---|
24 | 24 | | Sec. 213.006. ENVIRONMENTAL EVALUATION REPORT. (a) As |
---|
25 | 25 | | part of a municipality's comprehensive plan, the municipality's |
---|
26 | 26 | | governing body must also adopt an environmental evaluation report |
---|
27 | 27 | | that includes: |
---|
28 | 28 | | (1) projections regarding adverse and beneficial |
---|
29 | 29 | | environmental results that may be reasonably anticipated due to |
---|
30 | 30 | | implementation of the comprehensive plan, including changes in air, |
---|
31 | 31 | | water, and soil quality; |
---|
32 | 32 | | (2) plans for the identification and monitoring of, |
---|
33 | 33 | | and protection against, any adverse environmental results |
---|
34 | 34 | | projected under Subdivision (1); and |
---|
35 | 35 | | (3) either: |
---|
36 | 36 | | (A) an assessment of the cost to remedy or |
---|
37 | 37 | | mitigate any adverse results projected under Subdivision (1); or |
---|
38 | 38 | | (B) a feasibility study of alternative planning |
---|
39 | 39 | | that mitigates those projected adverse results. |
---|
40 | 40 | | (b) The environmental evaluation report may include: |
---|
41 | 41 | | (1) the organizational structure of community |
---|
42 | 42 | | planning committees; and |
---|
43 | 43 | | (2) the identification of best practices, procedures, |
---|
44 | 44 | | processes, and resources for developing, implementing, achieving, |
---|
45 | 45 | | reviewing, and maintaining continuous improvement in environmental |
---|
46 | 46 | | policy. |
---|
47 | 47 | | SECTION 3. This Act takes effect September 1, 2019. |
