55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to requirements regarding a municipality's comprehensive
88 plan for long-range development, including adoption of an
99 environmental report.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 213.003, Local Government Code, is
1212 amended by amending Subsection (a) and adding Subsection (c) to
1313 read as follows:
1414 (a) A comprehensive plan may be adopted or amended only by
1515 ordinance following:
1616 (1) a hearing at which the public is given the
1717 opportunity to give testimony and present written evidence; and
1818 (2) review by the municipality's planning commission
1919 or department, if one exists.
2020 (c) The governing body of a municipality that has adopted a
2121 comprehensive plan shall update the plan at least every five years.
2222 SECTION 2. Chapter 213, Local Government Code, is amended
2323 by adding Section 213.006 to read as follows:
2424 Sec. 213.006. ENVIRONMENTAL EVALUATION REPORT. (a) As
2525 part of a municipality's comprehensive plan, the municipality's
2626 governing body must also adopt an environmental evaluation report
2727 that includes:
2828 (1) projections regarding adverse and beneficial
2929 environmental results that may be reasonably anticipated due to
3030 implementation of the comprehensive plan, including changes in air,
3131 water, and soil quality;
3232 (2) plans for the identification and monitoring of,
3333 and protection against, any adverse environmental results
3434 projected under Subdivision (1); and
3535 (3) either:
3636 (A) an assessment of the cost to remedy or
3737 mitigate any adverse results projected under Subdivision (1); or
3838 (B) a feasibility study of alternative planning
3939 that mitigates those projected adverse results.
4040 (b) The environmental evaluation report may include:
4141 (1) the organizational structure of community
4242 planning committees; and
4343 (2) the identification of best practices, procedures,
4444 processes, and resources for developing, implementing, achieving,
4545 reviewing, and maintaining continuous improvement in environmental
4646 policy.
4747 SECTION 3. This Act takes effect September 1, 2019.
