| 7 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 14 | | SECTION 1. Section 713.008, Health and Safety Code, is |
|---|
| 9 | 15 | | amended to read as follows: |
|---|
| 10 | 16 | | Sec. 713.008. TERMINATION OF MUNICIPAL TRUST BY CERTAIN |
|---|
| 11 | 17 | | MUNICIPALITIES. (a) The governing body of a municipality in a |
|---|
| 12 | 18 | | county with a population of at least 128,000 but not more than |
|---|
| 13 | 19 | | 300,000 may abolish the municipality's perpetual trust fund for a |
|---|
| 14 | 20 | | cemetery and use the fund, including both principal and interest, |
|---|
| 15 | 21 | | for permanent improvements to the cemetery. |
|---|
| 16 | 22 | | (b) The governing body of a municipality in a county with a |
|---|
| 17 | 23 | | population of at least 40,000 but not more than 80,000 and that |
|---|
| 18 | 24 | | contains a portion of the Angelina National Forest may abolish the |
|---|
| 19 | 25 | | municipality's perpetual trust fund for a cemetery and use the |
|---|
| 20 | 26 | | fund, including both principal and interest, for permanent |
|---|
| 21 | 27 | | improvements to the cemetery. Termination of a trust fund under |
|---|
| 22 | 28 | | this subsection does not constitute renouncement of a trust or |
|---|
| 23 | 29 | | failure to act as its trustee under this subchapter. |

| 24 | 30 | | SECTION 2. This Act takes effect September 1, 2019. |
