410 AN ACT
511 relating to the use of a perpetual trust fund for a cemetery by
612 certain municipalities.
713 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
814 SECTION 1. Section 713.008, Health and Safety Code, is
915 amended to read as follows:
1016 Sec. 713.008. TERMINATION OF MUNICIPAL TRUST BY CERTAIN
1117 MUNICIPALITIES. (a) The governing body of a municipality in a
1218 county with a population of at least 128,000 but not more than
1319 300,000 may abolish the municipality's perpetual trust fund for a
1420 cemetery and use the fund, including both principal and interest,
1521 for permanent improvements to the cemetery.
1622 (b) The governing body of a municipality in a county with a
1723 population of at least 40,000 but not more than 80,000 and that
1824 contains a portion of the Angelina National Forest may abolish the
1925 municipality's perpetual trust fund for a cemetery and use the
2026 fund, including both principal and interest, for permanent
2127 improvements to the cemetery. Termination of a trust fund under
2228 this subsection does not constitute renouncement of a trust or
2329 failure to act as its trustee under this subchapter.
2430 SECTION 2. This Act takes effect September 1, 2019.
