86 AN ACT
97 relating to reimbursement of federal military treatment facilities
108 under the workers' compensation system.
119 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1210 SECTION 1. Subchapter B, Chapter 413, Labor Code, is
1311 amended by adding Section 413.0112 to read as follows:
1412 Sec. 413.0112. REIMBURSEMENT OF FEDERAL MILITARY TREATMENT
1513 FACILITY. (a) In this section, "federal military treatment
1614 facility" means a medical facility that operates as part of the
1715 Military Health System of the United States Department of Defense.
1816 (b) The reimbursement rates for medical services provided
1917 to an injured employee by a federal military treatment facility
20- must be the amount charged by the facility as determined under 32
21- C.F.R. Part 220.
18+ must be equal to the rates at which a third-party payer is required
19+ to reimburse a treatment facility for the same services as
20+ determined under 32 C.F.R. Part 220.
2221 (c) Chapter 1305, Insurance Code, and the following
2322 sections of this code do not apply to the reimbursement of a federal
2423 military treatment facility's charges for medical services
2524 provided to an injured employee:
2625 (1) Sections 408.027(a) and (f);
2726 (2) Section 408.0271;
2827 (3) Section 408.0272;
2928 (4) Section 408.028;
3029 (5) Section 408.0281;
3130 (6) Section 413.011;
3231 (7) Section 413.014;
33- (8) Section 413.031, as that section relates to
34- medical fee disputes;
35- (9) Section 413.041; and
36- (10) Section 504.053.

33+ (9) Section 413.032;
34+ (10) Section 413.041; and
35+ (11) Section 504.053.
3736 (d) The commissioner shall adopt rules necessary to
3837 implement this section, including rules establishing:
3938 (1) requirements for processing medical bills for
4039 services provided to an injured employee by a federal military
4140 treatment facility; and
4241 (2) a separate medical dispute resolution process to
4342 resolve disputes over charges billed directly to an injured
4443 employee by a federal military treatment facility.
4544 SECTION 2. The commissioner of workers' compensation shall
4645 adopt rules as required by Section 413.0112, Labor Code, as added by
4746 this Act, not later than December 1, 2019.
4847 SECTION 3. The change in law made by this Act applies only
4948 to health care services provided on or after January 1, 2020, in
5049 conjunction with a claim for workers' compensation benefits,
5150 regardless of the date on which the compensable injury that is the
5251 basis of the claim occurred.
5352 SECTION 4. This Act takes effect September 1, 2019.
