10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
11 | 11 | SECTION 1. Section 26.011(b), Education Code, is amended to | |
12 | 12 | read as follows: | |
13 | 13 | (b) The board of trustees of a school district is not | |
14 | 14 | required by Subsection (a) or Section 11.1511(b)(13) to address a | |
15 | 15 | complaint that the board receives concerning, relating to, or | |
16 | 16 | arising from a student's or parent's participation in an | |
17 | 17 | extracurricular activity that does not involve a violation of a | |
18 | 18 | right guaranteed by this chapter. This subsection does not affect a | |
19 | 19 | claim brought by a parent under the Individuals with Disabilities | |
20 | 20 | Education Act (20 U.S.C. Section 1400 et seq.) or a successor | |
21 | 21 | federal statute addressing special education services for a child | |
22 | 22 | with a disability. | |
23 | 23 | SECTION 2. This Act applies beginning with the 2019-2020 | |
24 | 24 | school year. | |
25 | 25 | SECTION 3. This Act takes effect immediately if it receives | |
26 | 26 | a vote of two-thirds of all the members elected to each house, as | |
27 | 27 | provided by Section 39, Article III, Texas Constitution. If this | |
28 | 28 | Act does not receive the vote necessary for immediate effect, this | |
29 | 29 | Act takes effect September 1, 2019. |
