66 AN ACT
77 relating to consideration by the board of trustees of a school
88 district of parental complaints regarding student or parent
99 participation in an extracurricular activity.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 26.011(b), Education Code, is amended to
1212 read as follows:
1313 (b) The board of trustees of a school district is not
1414 required by Subsection (a) or Section 11.1511(b)(13) to address a
1515 complaint that the board receives concerning, relating to, or
1616 arising from a student's or parent's participation in an
1717 extracurricular activity that does not involve a violation of a
1818 right guaranteed by this chapter. This subsection does not affect a
1919 claim brought by a parent under the Individuals with Disabilities
2020 Education Act (20 U.S.C. Section 1400 et seq.) or a successor
2121 federal statute addressing special education services for a child
2222 with a disability.
2323 SECTION 2. This Act applies beginning with the 2019-2020
2424 school year.
2525 SECTION 3. This Act takes effect immediately if it receives
2626 a vote of two-thirds of all the members elected to each house, as
2727 provided by Section 39, Article III, Texas Constitution. If this
2828 Act does not receive the vote necessary for immediate effect, this
2929 Act takes effect September 1, 2019.
