66 AN ACT
77 relating to prohibiting a municipality from requiring an employer
88 to provide paid sick leave.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subtitle D, Title 2, Labor Code, is amended by
1111 adding Chapter 83 to read as follows:
1212 CHAPTER 83. MUNICIPAL REGULATION OF EMPLOYMENT LEAVE
1313 Sec. 83.001. DEFINITIONS. In this chapter:
1414 (1) "Employee" means an individual who is employed by
1515 an employer for compensation.
1616 (2) "Employer" means a person who employs one or more
1717 employees.
1818 Sec. 83.002. MUNICIPAL REGULATION OF SICK LEAVE PROHIBITED.
1919 (a) The governing body of a municipality may not adopt or enforce
2020 any ordinance, rule, or regulation that requires an employer to
2121 provide to an employee paid sick leave.
2222 (b) An ordinance, rule, or regulation that violates
2323 Subsection (a) is void and unenforceable.
2424 SECTION 2. Chapter 83, Labor Code, as added by this Act,
2525 applies to an ordinance, rule, or regulation adopted before, on, or
2626 after the effective date of this Act.
2727 SECTION 3. This Act takes effect September 1, 2019.
