6 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

7 | 13 | | SECTION 1. Section 755.026, Health and Safety Code, is |
---|
8 | 14 | | amended by amending Subsection (a) and adding Subsection (c-1) to |
---|
9 | 15 | | read as follows: |
---|
10 | 16 | | (a) With the approval of the executive director and the |
---|
11 | 17 | | inspection agency that has jurisdiction for the power boiler, the |
---|
12 | 18 | | interval between internal inspections may be extended to a period |
---|
13 | 19 | | not exceeding a total of 60 months. For unfired steam boilers or |
---|
14 | 20 | | steam collection or liberation drums of process steam generators, |
---|
15 | 21 | | the inspection interval may be extended to the next scheduled |
---|
16 | 22 | | downtime of the boiler, but not exceeding a total of: |
---|
17 | 23 | | (1) 84 months for unfired steam boilers; [or] |
---|
18 | 24 | | (2) 120 months for steam collection or liberation |
---|
19 | 25 | | drums of process steam generators manufactured before January 1, |
---|
20 | 26 | | 1970; or |
---|
21 | 27 | | (3) 144 months for steam collection or liberation |
---|
22 | 28 | | drums of process steam generators manufactured on or after January |
---|
23 | 29 | | 1, 1970. |
---|
24 | 30 | | (c-1) The executive director and the inspection agency on |
---|
25 | 31 | | request may grant an extension for a period not to exceed 24 months |
---|
26 | 32 | | in addition to the extension authorized under Subsection (a)(2). |
---|
27 | 33 | | The request must include a report issued by an engineer licensed by |
---|
28 | 34 | | the Texas Board of Professional Engineers certifying: |
---|
29 | 35 | | (1) completion in accordance with industry standards |
---|
30 | 36 | | of a quantitative engineering assessment for in-service equipment, |
---|
31 | 37 | | repairs, and alterations prescribed by the National Board |
---|
32 | 38 | | Inspection Code NB23; and |
---|
33 | 39 | | (2) based on the assessment, the steam collection or |
---|
34 | 40 | | liberation drums of the process steam generator are safe to |
---|
35 | 41 | | operate. |
---|
36 | 42 | | SECTION 2. This Act takes effect September 1, 2019. |
