55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the regulation of the fitting and dispensing of hearing
88 instruments by audiologists and audiologist interns.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 401.403(b), Occupations Code, is amended
1111 to read as follows:
1212 (b) A person who holds a license [meets the requirements of
1313 this chapter for licensing] as an audiologist or audiologist intern
1414 and who fits and dispenses hearing instruments must:
1515 (1) [register with the department the person's
1616 intention to fit and dispense hearing instruments;
1717 [(2)] comply with rules adopted under this chapter
1818 related to fitting and dispensing hearing instruments [the
1919 profession's code of ethics];
2020 (2) [(3)] comply with the federal Food and Drug
2121 Administration guidelines for fitting and dispensing hearing
2222 instruments;
2323 (3) [(4)] when providing services in this state, use a
2424 written contract that contains the department's name, mailing
2525 address, [and] telephone number, and Internet website address; and
2626 (4) [(5)] follow the guidelines adopted by commission
2727 rule for a 30-day trial period on every hearing instrument
2828 purchased.
2929 SECTION 2. This Act takes effect September 1, 2019.
