55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the presence of a minor on the premises of a sexually
88 oriented business that is permitted or licensed under the Alcoholic
99 Beverage Code; creating a criminal offense.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Chapter 106, Alcoholic Beverage Code, is amended
1212 by adding Section 106.17 to read as follows:
1313 Sec. 106.17. PRESENCE OF MINOR ON PERMITTED OR LICENSED
1414 PREMISES OPERATING AS A SEXUALLY ORIENTED BUSINESS. (a) A minor
1515 may not be on premises covered by a permit or license issued under
1616 this code if a sexually oriented business, as defined by Section
1717 243.002, Local Government Code, operates on the premises.
1818 (b) The holder of a permit or license covering a premises
1919 described by Subsection (a) may not knowingly or recklessly allow a
2020 minor to be on the premises.
2121 (c) The holder of a permit or license who violates
2222 Subsection (b) commits an offense. An offense under this
2323 subsection is a Class A misdemeanor.
2424 SECTION 2. This Act takes effect immediately if it receives
2525 a vote of two-thirds of all the members elected to each house, as
2626 provided by Section 39, Article III, Texas Constitution. If this
2727 Act does not receive the vote necessary for immediate effect, this
2828 Act takes effect September 1, 2019.
