| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Subchapter C, Chapter 121, Utilities Code, is | |
| 11 | 11 | amended by adding Section 121.105 to read as follows: | |
| 12 | 12 | Sec. 121.105. ENVIRONMENTAL ASSESSMENT BEFORE CONSTRUCTION | |
| 13 | 13 | OF PIPELINE. A person seeking to construct a pipeline to which this | |
| 14 | 14 | chapter applies may not begin construction of the pipeline unless | |
| 15 | 15 | the person first performs an analysis to identify and assess | |
| 16 | 16 | potential impacts on endangered and threatened species, air and | |
| 17 | 17 | water quality, aquifers, and historic, cultural, and | |
| 18 | 18 | archaeological sites that could result from the construction and | |
| 19 | 19 | operation of the pipeline and delivers the analysis to the railroad | |
| 20 | 20 | commission in writing. | |
| 21 | 21 | SECTION 2. The changes in law made by this Act apply only to | |
| 22 | 22 | the construction of a pipeline that begins on or after the effective | |
| 23 | 23 | date of this Act. Construction that begins before the effective | |
| 24 | 24 | date of this Act is governed by the law in effect immediately before | |
| 25 | 25 | that date, and the former law is continued in effect for that | |
| 26 | 26 | purpose. | |
| 27 | 27 | SECTION 3. This Act takes effect September 1, 2019. |
