7 | 7 | | relating to the representation of an individual or legal entity by a |
---|
8 | 8 | | member of the legislature for compensation before a state agency. |
---|
9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 572.025, Government Code, is amended to |
---|
11 | 11 | | read as follows: |
---|
12 | 12 | | Sec. 572.025. INFORMATION ABOUT LEGISLATORS' |
---|
13 | 13 | | REPRESENTATION BEFORE EXECUTIVE STATE AGENCIES. A member of the |
---|
14 | 14 | | legislature who represents another individual, business entity, |
---|
15 | 15 | | state agency, government, governmental subdivision, special |
---|
16 | 16 | | district, or other legal entity [person] for compensation before an |
---|
17 | 17 | | executive state agency shall report on the financial statement: |
---|
18 | 18 | | (1) the name of the agency; |
---|
19 | 19 | | (2) the individual, business entity, state agency, |
---|
20 | 20 | | government, governmental subdivision, special district, or other |
---|
21 | 21 | | legal entity [person] represented by the member; and |
---|
22 | 22 | | (3) the category of the amount of compensation |
---|
23 | 23 | | received by the member for that representation. |
---|
24 | 24 | | SECTION 2. Section 572.052(a), Government Code, is amended |
---|
25 | 25 | | to read as follows: |
---|
26 | 26 | | (a) A member of the legislature may not, for compensation, |
---|
27 | 27 | | represent another individual, business entity, state agency, |
---|
28 | 28 | | government, governmental subdivision, special district, or other |
---|
29 | 29 | | legal entity [person] before a state agency in the executive branch |
---|
30 | 30 | | of state government unless the representation: |
---|
31 | 31 | | (1) is pursuant to an attorney-client relationship in |
---|
32 | 32 | | a criminal law matter; or |
---|
33 | 33 | | (2) involves the filing of documents that involve only |
---|
34 | 34 | | ministerial acts on the part of the commission, agency, board, |
---|
35 | 35 | | department, or officer. |
---|
36 | 36 | | SECTION 3. The changes in law made by this Act to Section |
---|
37 | 37 | | 572.025, Government Code, apply only to a financial statement due |
---|
38 | 38 | | on or after the effective date of this Act. A financial statement |
---|
39 | 39 | | due before the effective date of this Act is governed by the law in |
---|
40 | 40 | | effect on the date the financial statement was due, and the former |
---|
41 | 41 | | law is continued in effect for that purpose. |
---|
42 | 42 | | SECTION 4. (a) The change in law made by this Act to Section |
---|
43 | 43 | | 572.052, Government Code, applies only to an offense committed on |
---|
44 | 44 | | or after the effective date of this Act. For purposes of this |
---|
45 | 45 | | section, an offense is committed before the effective date of this |
---|
46 | 46 | | Act if any element of the offense occurs before that date. |
---|
47 | 47 | | (b) An offense committed before the effective date of this |
---|
48 | 48 | | Act is governed by the law in effect when the offense was committed, |
---|
49 | 49 | | and the former law is continued in effect for that purpose. |
---|
50 | 50 | | SECTION 5. This Act takes effect September 1, 2019. |
