55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the representation of an individual or legal entity by a
88 member of the legislature for compensation before a state agency.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 572.025, Government Code, is amended to
1111 read as follows:
1212 Sec. 572.025. INFORMATION ABOUT LEGISLATORS'
1313 REPRESENTATION BEFORE EXECUTIVE STATE AGENCIES. A member of the
1414 legislature who represents another individual, business entity,
1515 state agency, government, governmental subdivision, special
1616 district, or other legal entity [person] for compensation before an
1717 executive state agency shall report on the financial statement:
1818 (1) the name of the agency;
1919 (2) the individual, business entity, state agency,
2020 government, governmental subdivision, special district, or other
2121 legal entity [person] represented by the member; and
2222 (3) the category of the amount of compensation
2323 received by the member for that representation.
2424 SECTION 2. Section 572.052(a), Government Code, is amended
2525 to read as follows:
2626 (a) A member of the legislature may not, for compensation,
2727 represent another individual, business entity, state agency,
2828 government, governmental subdivision, special district, or other
2929 legal entity [person] before a state agency in the executive branch
3030 of state government unless the representation:
3131 (1) is pursuant to an attorney-client relationship in
3232 a criminal law matter; or
3333 (2) involves the filing of documents that involve only
3434 ministerial acts on the part of the commission, agency, board,
3535 department, or officer.
3636 SECTION 3. The changes in law made by this Act to Section
3737 572.025, Government Code, apply only to a financial statement due
3838 on or after the effective date of this Act. A financial statement
3939 due before the effective date of this Act is governed by the law in
4040 effect on the date the financial statement was due, and the former
4141 law is continued in effect for that purpose.
4242 SECTION 4. (a) The change in law made by this Act to Section
4343 572.052, Government Code, applies only to an offense committed on
4444 or after the effective date of this Act. For purposes of this
4545 section, an offense is committed before the effective date of this
4646 Act if any element of the offense occurs before that date.
4747 (b) An offense committed before the effective date of this
4848 Act is governed by the law in effect when the offense was committed,
4949 and the former law is continued in effect for that purpose.
5050 SECTION 5. This Act takes effect September 1, 2019.
