5 | 12 | | relating to the placement of a slow-moving-vehicle emblem. |

6 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

7 | 14 | | SECTION 1. Section 547.703(a), Transportation Code, is |
---|
8 | 15 | | amended to read as follows: |
---|
9 | 16 | | (a) Except as provided by Subsection (b), a slow-moving |
---|
10 | 17 | | vehicle shall display a slow-moving-vehicle emblem that: |
---|
11 | 18 | | (1) has a reflective surface designed to be clearly |
---|
12 | 19 | | visible in daylight or at night from the light of standard |
---|
13 | 20 | | automobile headlamps at a distance of at least 500 feet; |
---|
14 | 21 | | (2) is mounted base down on the rear of the vehicle and |
---|
15 | 22 | | at a height that does not impair the visibility of the emblem [from |
---|
16 | 23 | | three to five feet above the road surface]; and |
---|
17 | 24 | | (3) is maintained in a clean, reflective condition. |

18 | 25 | | SECTION 2. The change in law made by this Act applies only |
---|
19 | 26 | | to an offense committed on or after the effective date of this Act. |
---|
20 | 27 | | An offense committed before the effective date of this Act is |
---|
21 | 28 | | governed by the law in effect on the date the offense was committed, |
---|
22 | 29 | | and the former law is continued in effect for that purpose. For |
---|
23 | 30 | | purposes of this section, an offense was committed before the |
---|
24 | 31 | | effective date of this Act if any element of the offense was |
---|
25 | 32 | | committed before that date. |
---|
26 | 33 | | SECTION 3. This Act takes effect September 1, 2019. |
