410 AN ACT
511 relating to an exemption from licensing requirements for physicians
612 associated with certain sports teams.
713 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
814 SECTION 1. Subchapter B, Chapter 151, Occupations Code, is
915 amended by adding Section 151.0521 to read as follows:
1016 Sec. 151.0521. EXEMPTION FOR SPORTS TEAM PHYSICIAN. A
1117 person is exempt from the licensing requirements of this subtitle
1218 and may engage in the practice of medicine in this state if the
1319 person:
1420 (1) is employed or designated as a team physician by a
1521 sports team visiting this state for a specific sporting event;
1622 (2) is licensed to practice medicine in the team's home
1723 state; and
1824 (3) limits the person's practice of medicine in this
1925 state to treating, during the period beginning on the date the team
2026 arrives in this state for the event and ending on the date the team
2127 leaves this state:
2228 (A) the members, coaches, and staff of the team;
2329 and
2430 (B) a family member of a person described by
2531 Paragraph (A) if the family member is visiting this state for the
2632 event.
2733 SECTION 2. Section 451.003, Occupations Code, is amended to
2834 read as follows:
2935 Sec. 451.003. APPLICABILITY. This chapter does not apply
3036 to:
3137 (1) a physician licensed by the Texas Medical Board or
3238 engaged in the practice of medicine as authorized by Section
3339 151.0521;
3440 (2) a dentist, licensed under the laws of this state,
3541 engaged in the practice of dentistry;
3642 (3) a licensed optometrist or therapeutic optometrist
3743 engaged in the practice of optometry or therapeutic optometry as
3844 defined by statute;
3945 (4) an occupational therapist engaged in the practice
4046 of occupational therapy;
4147 (5) a nurse engaged in the practice of nursing;
4248 (6) a licensed podiatrist engaged in the practice of
4349 podiatry as defined by statute;
4450 (7) a physical therapist engaged in the practice of
4551 physical therapy;
4652 (8) a registered massage therapist engaged in the
4753 practice of massage therapy;
4854 (9) a commissioned or contract physician, physical
4955 therapist, or physical therapist assistant in the United States
5056 Army, Navy, Air Force, or Public Health Service; or
5157 (10) an athletic trainer who does not live in this
5258 state, who is licensed, registered, or certified by an authority
5359 recognized by the department, and who provides athletic training in
5460 this state for a period determined by the department.
5561 SECTION 3. This Act takes effect September 1, 2019.
