7 | 7 | | relating to a study regarding the public health considerations of |
---|
8 | 8 | | transportation planning. |
---|
9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
---|
10 | 10 | | SECTION 1. INTERIM COMMITTEE; STUDY. (a) The joint interim |
---|
11 | 11 | | committee on the public health considerations of transportation |
---|
12 | 12 | | planning is established to study and review the methods the Texas |
---|
13 | 13 | | Department of Transportation uses to integrate public health |
---|
14 | 14 | | considerations into major highway project planning and general |
---|
15 | 15 | | department policy. |
---|
16 | 16 | | (b) The study must consider: |
---|
17 | 17 | | (1) the extent to which the Texas Department of |
---|
18 | 18 | | Transportation, when planning major highway projects, currently |
---|
19 | 19 | | considers the effects increased traffic capacity may have on the |
---|
20 | 20 | | health of adjacent populations; and |
---|
21 | 21 | | (2) methods that may be employed by the Texas |
---|
22 | 22 | | Department of Transportation to incorporate public health |
---|
23 | 23 | | considerations into major highway project planning, including: |
---|
24 | 24 | | (A) conducting health effects assessments to |
---|
25 | 25 | | determine the effects a major highway project may have on the health |
---|
26 | 26 | | of adjacent populations and publishing the resulting findings; |
---|
27 | 27 | | (B) notifying affected communities when a major |
---|
28 | 28 | | highway project may pose a public health risk to vulnerable |
---|
29 | 29 | | populations concentrated in nearby areas, such as at schools; and |
---|
30 | 30 | | (C) considering alternative multimodal |
---|
31 | 31 | | transportation options to achieve the stated goal of a |
---|
32 | 32 | | transportation improvement project. |
---|
33 | 33 | | (c) The joint interim committee shall be composed of: |
---|
34 | 34 | | (1) six members of the senate transportation committee |
---|
35 | 35 | | appointed by the lieutenant governor; |
---|
36 | 36 | | (2) three members of the house transportation |
---|
37 | 37 | | committee appointed by the speaker of the house of representatives; |
---|
38 | 38 | | and |
---|
39 | 39 | | (3) three members of the house environmental |
---|
40 | 40 | | regulation committee appointed by the speaker of the house of |
---|
41 | 41 | | representatives. |
---|
42 | 42 | | (d) The lieutenant governor and speaker of the house of |
---|
43 | 43 | | representatives shall each designate a co-chair from among the |
---|
44 | 44 | | committee members. |
---|
45 | 45 | | (e) The joint interim committee has all other powers and |
---|
46 | 46 | | duties provided to a special or select committee by the rules of the |
---|
47 | 47 | | senate and house of representatives by Subchapter B, Chapter 301, |
---|
48 | 48 | | Government Code, and by policies of the senate and house committees |
---|
49 | 49 | | on administration. |
---|
50 | 50 | | (f) Not later than January 1, 2021, the joint interim |
---|
51 | 51 | | committee shall report the committee's findings and |
---|
52 | 52 | | recommendations to the governor and the members of the legislature. |
---|
53 | 53 | | SECTION 2. ABOLITION OF COMMITTEE. The committee is |
---|
54 | 54 | | abolished and this Act expires January 12, 2021. |
---|
55 | 55 | | SECTION 3. EFFECTIVE DATE. This Act takes effect |
---|
56 | 56 | | immediately if it receives a vote of two-thirds of all the members |
---|
57 | 57 | | elected to each house, as provided by Section 39, Article III, Texas |
---|
58 | 58 | | Constitution. If this Act does not receive the vote necessary for |
---|
59 | 59 | | immediate effect, this Act takes effect September 1, 2019. |
