| 7 | 7 | | relating to a Medicaid buy-in program for Medicaid recipients with |

| 8 | 8 | | increased household income from employment with a small business. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter B, Chapter 531, Government Code, is |
|---|
| 11 | 11 | | amended by adding Section 531.024442 to read as follows: |
|---|
| 12 | 12 | | Sec. 531.024442. MEDICAID BUY-IN PROGRAM FOR CERTAIN |
|---|
| 13 | 13 | | PERSONS WITH INCREASED HOUSEHOLD INCOME FROM EMPLOYMENT. (a) In |
|---|
| 14 | 14 | | this section, "small business" means a business with an annual |
|---|
| 15 | 15 | | gross revenue of $850,000 or less. |
|---|
| 16 | 16 | | (b) The commission shall operate a Medicaid buy-in program |
|---|
| 17 | 17 | | for Medicaid recipients: |
|---|
| 18 | 18 | | (1) who are not eligible for a Medicaid buy-in program |
|---|
| 19 | 19 | | established under Section 531.02444; and |
|---|
| 20 | 20 | | (2) whose eligibility for Medicaid is otherwise being |
|---|
| 21 | 21 | | terminated solely because of an increase in household income |
|---|
| 22 | 22 | | received from employment with a small business. |
|---|
| 23 | 23 | | (c) The program under this section must be substantively |
|---|
| 24 | 24 | | identical to the Medicaid buy-in programs for persons with |
|---|
| 25 | 25 | | disabilities established under Section 531.02444, except to the |
|---|
| 26 | 26 | | extent that programmatic differences are appropriate because of the |
|---|
| 27 | 27 | | populations served by the programs. |
|---|
| 28 | 28 | | (d) The executive commissioner shall adopt rules for |
|---|
| 29 | 29 | | participation in the program under this section that provide for: |
|---|
| 30 | 30 | | (1) eligibility requirements, including household |
|---|
| 31 | 31 | | income limits for participation; and |
|---|
| 32 | 32 | | (2) requirements for program participants to pay |
|---|
| 33 | 33 | | premiums or cost-sharing payments. |
|---|
| 34 | 34 | | SECTION 2. Not later than January 1, 2020, the executive |
|---|
| 35 | 35 | | commissioner of the Health and Human Services Commission shall |
|---|
| 36 | 36 | | adopt the rules required by Section 531.024442, Government Code, as |
|---|
| 37 | 37 | | added by this Act, and the commission shall implement the program |
|---|
| 38 | 38 | | required by that section. |
|---|
| 39 | 39 | | SECTION 3. If before implementing any provision of this Act |
|---|
| 40 | 40 | | a state agency determines that a waiver or authorization from a |
|---|
| 41 | 41 | | federal agency is necessary for implementation of that provision, |
|---|
| 42 | 42 | | the agency affected by the provision shall request the waiver or |
|---|
| 43 | 43 | | authorization and may delay implementing that provision until the |
|---|
| 44 | 44 | | waiver or authorization is granted. |
|---|
| 45 | 45 | | SECTION 4. This Act takes effect September 1, 2019. |
