55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a Medicaid buy-in program for Medicaid recipients with
88 increased household income from employment with a small business.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 531, Government Code, is
1111 amended by adding Section 531.024442 to read as follows:
1212 Sec. 531.024442. MEDICAID BUY-IN PROGRAM FOR CERTAIN
1313 PERSONS WITH INCREASED HOUSEHOLD INCOME FROM EMPLOYMENT. (a) In
1414 this section, "small business" means a business with an annual
1515 gross revenue of $850,000 or less.
1616 (b) The commission shall operate a Medicaid buy-in program
1717 for Medicaid recipients:
1818 (1) who are not eligible for a Medicaid buy-in program
1919 established under Section 531.02444; and
2020 (2) whose eligibility for Medicaid is otherwise being
2121 terminated solely because of an increase in household income
2222 received from employment with a small business.
2323 (c) The program under this section must be substantively
2424 identical to the Medicaid buy-in programs for persons with
2525 disabilities established under Section 531.02444, except to the
2626 extent that programmatic differences are appropriate because of the
2727 populations served by the programs.
2828 (d) The executive commissioner shall adopt rules for
2929 participation in the program under this section that provide for:
3030 (1) eligibility requirements, including household
3131 income limits for participation; and
3232 (2) requirements for program participants to pay
3333 premiums or cost-sharing payments.
3434 SECTION 2. Not later than January 1, 2020, the executive
3535 commissioner of the Health and Human Services Commission shall
3636 adopt the rules required by Section 531.024442, Government Code, as
3737 added by this Act, and the commission shall implement the program
3838 required by that section.
3939 SECTION 3. If before implementing any provision of this Act
4040 a state agency determines that a waiver or authorization from a
4141 federal agency is necessary for implementation of that provision,
4242 the agency affected by the provision shall request the waiver or
4343 authorization and may delay implementing that provision until the
4444 waiver or authorization is granted.
4545 SECTION 4. This Act takes effect September 1, 2019.
