77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 42.155, Education Code, Subsection (g)
99 is amended to read as follows:
1010 (g) A school district or county that provides special
1111 transportation services for eligible special education students or
1212 homeless students as defined by 42 U.S.C. Section 11302 i
1313 s entitled
1414 to a state allocation paid on a previous year's cost-per-mile
1515 basis. The maximum rate per mile allowable shall be set by
1616 appropriation based on data gathered from the first year of each
1717 preceding biennium. Districts may use a portion of their support
1818 allocation to pay transportation costs, if necessary. The
1919 commissioner may grant an amount set by appropriation for private
2020 transportation to reimburse parents or their agents for
2121 transporting eligible special education students. The mileage
2222 allowed shall be computed along the shortest public road from the
2323 student's home to school and back, morning and afternoon. The need
2424 for this type transportation shall be determined on an individual
2525 basis and shall be approved only in extreme hardship cases.
2626 SECTION 2. This Act takes effect September 1, 2019.
