66 AN ACT
77 relating to the development of a contract template and contracting
88 guidance for debris removal and monitoring contracts of political
99 subdivisions.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter C, Chapter 418, Government Code, is
1212 amended by adding Section 418.054 to read as follows:
1313 Sec. 418.054. DEBRIS CONTRACT GUIDANCE FOR POLITICAL
1414 SUBDIVISIONS. (a) In this section, "Hurricane Harvey" means the
1515 hurricane of that name that struck the southeastern region of this
1616 state in 2017.
1717 (b) The division, in consultation with political
1818 subdivisions and the Federal Emergency Management Agency, shall
1919 identify common issues that occurred after Hurricane Harvey with
2020 debris removal and monitoring contracts.
2121 (c) The division, in coordination with the comptroller,
2222 shall develop contracting standards and requirements for contracts
2323 used by political subdivisions when contracting for long-term and
2424 exigent debris removal and monitoring. The contracting standards
2525 and requirements must:
2626 (1) address the contracting issues identified under
2727 Subsection (b);
2828 (2) include provisions relating to the manner in which
2929 debris is removed, including requiring a contractor to make
3030 multiple passes to remove debris;
3131 (3) include provisions relating to requirements for
3232 contractors providing debris removal and monitoring services, such
3333 as requiring the contractor to:
3434 (A) have certain expertise;
3535 (B) be based in a certain location; and
3636 (C) have a certain number of employees and
3737 vehicles in the contractor's fleet;
3838 (4) include provisions that enhance the ability of
3939 political subdivisions to monitor contract compliance; and
4040 (5) include bonding requirements and penalties for
4141 failure to perform the contract.
4242 (d) The division shall develop:
4343 (1) a contract template incorporating the contracting
4444 standards and requirements developed under Subsection (c); and
4545 (2) contracting guidance that provides political
4646 subdivisions with an overview of federal contracting standards and
4747 requirements.
4848 (e) The division shall annually:
4949 (1) review federal statutory and regulatory changes to
5050 procedures regarding contracting; and
5151 (2) update the contract template and contracting
5252 guidance developed under Subsection (d) to reflect any changes.
5353 (f) The division shall distribute an updated contract
5454 template or updated contracting guidance to political subdivisions
5555 as soon as practicable.
5656 SECTION 2. This Act takes effect September 1, 2019.
