55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the places where certain knives are prohibited.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 46.03(a-1), Penal Code, is amended to
1010 read as follows:
1111 (a-1) A person commits an offense if the person
1212 intentionally, knowingly, or recklessly possesses or goes with a
1313 location-restricted knife:
1414 (1) [on the premises of a business that has a permit or
1515 license issued under Chapter 25, 28, 32, 69, or 74, Alcoholic
1616 Beverage Code, if the business derives 51 percent or more of its
1717 income from the sale or service of alcoholic beverages for
1818 on-premises consumption, as determined by the Texas Alcoholic
1919 Beverage Commission under Section 104.06, Alcoholic Beverage Code;
2020 [(2)] on the premises where a high school, collegiate,
2121 or professional sporting event or interscholastic event is taking
2222 place, unless the person is a participant in the event and a
2323 location-restricted knife is used in the event;
2424 (2) [(3)] on the premises of a correctional facility;
2525 (3) [(4)] on the premises of a hospital licensed under
2626 Chapter 241, Health and Safety Code, or on the premises of a nursing
2727 facility licensed under Chapter 242, Health and Safety Code, unless
2828 the person has written authorization of the hospital or nursing
2929 facility administration, as appropriate; or
3030 (4) [(5)] on the premises of a mental hospital, as
3131 defined by Section 571.003, Health and Safety Code, unless the
3232 person has written authorization of the mental hospital
3333 administration[;
3434 [(6) in an amusement park; or
3535 [(7) on the premises of a church, synagogue, or other
3636 established place of religious worship].
3737 SECTION 2. Section 46.03(c)(2), Penal Code, is amended to
3838 read as follows:
3939 (2) "Premises" has ["Amusement park" and "premises"
4040 have] the meaning [meanings] assigned by Section 46.035.
4141 SECTION 3. The change in law made by this Act applies only
4242 to an offense committed on or after the effective date of this Act.
4343 An offense committed before the effective date of this Act is
4444 governed by the law in effect on the date the offense was committed,
4545 and the former law is continued in effect for that purpose. For
4646 purposes of this section, an offense was committed before the
4747 effective date of this Act if any element of the offense occurred
4848 before that date.
4949 SECTION 4. This Act takes effect September 1, 2019.
