55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the classification of certain conduct by juveniles
88 constituting the offense of evading detention.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 51.03(b), Family Code, is amended to
1111 read as follows:
1212 (b) Conduct indicating a need for supervision is:
1313 (1) subject to Subsection (f), conduct, other than a
1414 traffic offense, that violates:
1515 (A) the penal laws of this state of the grade of
1616 misdemeanor that are punishable by fine only; or
1717 (B) the penal ordinances of any political
1818 subdivision of this state;
1919 (2) the voluntary absence of a child from the child's
2020 home without the consent of the child's parent or guardian for a
2121 substantial length of time or without intent to return;
2222 (3) conduct prohibited by city ordinance or by state
2323 law involving the inhalation of the fumes or vapors of paint and
2424 other protective coatings or glue and other adhesives and the
2525 volatile chemicals itemized in Section 485.001, Health and Safety
2626 Code;
2727 (4) an act that violates a school district's
2828 previously communicated written standards of student conduct for
2929 which the child has been expelled under Section 37.007(c),
3030 Education Code;
3131 (5) notwithstanding Subsection (a)(1), conduct
3232 described by Section 43.02(a) or (b), Penal Code; [or]
3333 (6) notwithstanding Subsection (a)(1), conduct that
3434 violates Section 43.261, Penal Code; or
3535 (7) notwithstanding Subsection (a)(1), conduct
3636 described by Section 38.04, Penal Code, that:
3737 (A) is punishable as a Class A misdemeanor under
3838 that section; and
3939 (B) only consists of intentionally fleeing a
4040 person the child knows is a peace officer or federal special
4141 investigator attempting lawfully to detain the child.
4242 SECTION 2. This Act applies only to conduct that occurs on
4343 or after the effective date of this Act. Conduct that occurs before
4444 the effective date of this Act is governed by the law in effect on
4545 the date the conduct occurred, and the former law is continued in
4646 effect for that purpose. For the purposes of this section, conduct
4747 occurred before the effective date of this Act if any element of the
4848 conduct occurred before that date.
4949 SECTION 3. This Act takes effect September 1, 2019.
