66 AN ACT
77 relating to the application requirements for first responder
88 organizations to receive an initial license or to renew a license.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 773.003(16), Health and Safety Code, is
1111 amended to read as follows:
1212 (16) "First responder organization" means a group or
1313 association of certified emergency medical services personnel
1414 that, working in cooperation with a licensed emergency medical
1515 services provider, provides immediate on-scene care under the
1616 direction of a medical director to ill or injured persons but does
1717 not transport those persons.
1818 SECTION 2. Subchapter C, Chapter 773, Health and Safety
1919 Code, is amended by adding Section 773.0416 to read as follows:
2020 Sec. 773.0416. ADDITIONAL APPLICATION REQUIREMENTS FOR
2121 FIRST RESPONDER ORGANIZATIONS. (a) To the extent the rules adopted
2222 under this chapter require a first responder organization to submit
2323 an application for a license, each first responder organization
2424 shall include with an application for an initial or renewal
2525 license:
2626 (1) for a first responder organization affiliated with
2727 an emergency medical services provider, notice of any disagreement
2828 regarding treatment protocols or equipment between the first
2929 responder organization's medical director and the emergency
3030 medical services provider's medical director; and
3131 (2) for a first responder organization not affiliated
3232 with an emergency medical services provider:
3333 (A) proof that the first responder
3434 organization's medical director provided a copy of the
3535 organization's treatment protocols to the medical director of each
3636 emergency medical services provider that provides patient
3737 transport services for patients treated by the organization's
3838 personnel and that has an agreement with the organization; and
3939 (B) notice of any disagreement regarding
4040 treatment protocols or equipment between the first responder
4141 organization's medical director and the medical director of each
4242 emergency medical services provider that has an agreement with the
4343 organization.
4444 (b) The executive commissioner may not require a first
4545 responder organization to obtain the approval of an emergency
4646 medical services provider's medical director regarding treatment
4747 protocols or equipment for issuance of an initial or renewal first
4848 responder organization license.
4949 SECTION 3. Section 773.0416, Health and Safety Code, as
5050 added by this Act, applies only to an application submitted on or
5151 after the effective date of this Act.
5252 SECTION 4. As soon as practicable after the effective date
5353 of this Act, the executive commissioner of the Health and Human
5454 Services Commission shall adopt any rules necessary to implement
5555 Section 773.0416, Health and Safety Code, as added by this Act.
5656 SECTION 5. This Act takes effect September 1, 2019.
