7 | 7 | | relating to the application requirements for first responder |

8 | 8 | | organizations to receive an initial license or to renew a license. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 773.003(16), Health and Safety Code, is |
---|
11 | 11 | | amended to read as follows: |
---|
12 | 12 | | (16) "First responder organization" means a group or |
---|
13 | 13 | | association of certified emergency medical services personnel |
---|
14 | 14 | | that, working in cooperation with a licensed emergency medical |
---|
15 | 15 | | services provider, provides immediate on-scene care under the |
---|
16 | 16 | | direction of a medical director to ill or injured persons but does |
---|
17 | 17 | | not transport those persons. |
---|
18 | 18 | | SECTION 2. Subchapter C, Chapter 773, Health and Safety |
---|
19 | 19 | | Code, is amended by adding Section 773.0416 to read as follows: |
---|
20 | 20 | | Sec. 773.0416. ADDITIONAL APPLICATION REQUIREMENTS FOR |
---|
21 | 21 | | FIRST RESPONDER ORGANIZATIONS. (a) To the extent the rules adopted |
---|
22 | 22 | | under this chapter require a first responder organization to submit |
---|
23 | 23 | | an application for a license, each first responder organization |
---|
24 | 24 | | shall include with an application for an initial or renewal |
---|
25 | 25 | | license: |
---|
26 | 26 | | (1) for a first responder organization affiliated with |
---|
27 | 27 | | an emergency medical services provider, notice of any disagreement |
---|
28 | 28 | | regarding treatment protocols or equipment between the first |
---|
29 | 29 | | responder organization's medical director and the emergency |
---|
30 | 30 | | medical services provider's medical director; and |
---|
31 | 31 | | (2) for a first responder organization not affiliated |
---|
32 | 32 | | with an emergency medical services provider: |
---|
33 | 33 | | (A) proof that the first responder |
---|
34 | 34 | | organization's medical director provided a copy of the |
---|
35 | 35 | | organization's treatment protocols to the medical director of each |
---|
36 | 36 | | emergency medical services provider that provides patient |
---|
37 | 37 | | transport services for patients treated by the organization's |
---|
38 | 38 | | personnel and that has an agreement with the organization; and |
---|
39 | 39 | | (B) notice of any disagreement regarding |
---|
40 | 40 | | treatment protocols or equipment between the first responder |
---|
41 | 41 | | organization's medical director and the medical director of each |
---|
42 | 42 | | emergency medical services provider that has an agreement with the |
---|
43 | 43 | | organization. |
---|
44 | 44 | | (b) The executive commissioner may not require a first |
---|
45 | 45 | | responder organization to obtain the approval of an emergency |
---|
46 | 46 | | medical services provider's medical director regarding treatment |
---|
47 | 47 | | protocols or equipment for issuance of an initial or renewal first |
---|
48 | 48 | | responder organization license. |
---|
49 | 49 | | SECTION 3. Section 773.0416, Health and Safety Code, as |
---|
50 | 50 | | added by this Act, applies only to an application submitted on or |
---|
51 | 51 | | after the effective date of this Act. |
---|
52 | 52 | | SECTION 4. As soon as practicable after the effective date |
---|
53 | 53 | | of this Act, the executive commissioner of the Health and Human |
---|
54 | 54 | | Services Commission shall adopt any rules necessary to implement |
---|
55 | 55 | | Section 773.0416, Health and Safety Code, as added by this Act. |
---|
56 | 56 | | SECTION 5. This Act takes effect September 1, 2019. |
