| 5 | 11 | | relating to the authority of physicians to delegate to certain |
|---|
| 6 | 12 | | pharmacists the implementation and modification of a patient's drug |
|---|
| 7 | 13 | | therapy. |
|---|
| 8 | 14 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 15 | | SECTION 1. Section 157.101, Occupations Code, is amended by |
|---|
| 10 | 16 | | amending Subsection (b-1) and adding Subsection (g) to read as |
|---|
| 11 | 17 | | follows: |
|---|
| 12 | 18 | | (b-1) A delegation under Subsection (b) may include the |
|---|
| 13 | 19 | | implementation or modification of a patient's drug therapy under a |
|---|
| 14 | 20 | | protocol, including the authority to sign a prescription drug order |
|---|
| 15 | 21 | | for dangerous drugs, if: |
|---|
| 16 | 22 | | (1) the delegation follows a diagnosis, initial |
|---|
| 17 | 23 | | patient assessment, and drug therapy order by the physician; |
|---|
| 18 | 24 | | (2) the pharmacist practices in a federally qualified |
|---|
| 19 | 25 | | health center, a hospital, a hospital-based clinic, or an academic |
|---|
| 20 | 26 | | health care institution; |
|---|
| 21 | 27 | | (3) the federally qualified health center, hospital, |
|---|
| 22 | 28 | | hospital-based clinic, or academic health care institution in which |
|---|
| 23 | 29 | | the pharmacist practices has bylaws and a medical staff policy that |
|---|
| 24 | 30 | | permit a physician to delegate to a pharmacist the management of a |
|---|
| 25 | 31 | | patient's drug therapy; |
|---|
| 26 | 32 | | (4) the pharmacist provides the name, address, and |
|---|
| 27 | 33 | | telephone number of the pharmacist and of the delegating physician |
|---|
| 28 | 34 | | on each prescription signed by the pharmacist; and |
|---|
| 29 | 35 | | (5) the pharmacist provides a copy of the protocol to |
|---|
| 30 | 36 | | the Texas State Board of Pharmacy. |
|---|
| 31 | 37 | | (g) In this section, "federally qualified health center" |
|---|
| 32 | 38 | | has the meaning assigned by Section 531.02192, Government Code. |

| 33 | 39 | | SECTION 2. This Act takes effect September 1, 2019. |
