9+ A BILL TO BE ENTITLED
410 AN ACT
511 relating to the authority of physicians to delegate to certain
612 pharmacists the implementation and modification of a patient's drug
713 therapy.
814 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
915 SECTION 1. Section 157.101, Occupations Code, is amended by
1016 amending Subsection (b-1) and adding Subsection (g) to read as
1117 follows:
1218 (b-1) A delegation under Subsection (b) may include the
1319 implementation or modification of a patient's drug therapy under a
1420 protocol, including the authority to sign a prescription drug order
1521 for dangerous drugs, if:
1622 (1) the delegation follows a diagnosis, initial
1723 patient assessment, and drug therapy order by the physician;
1824 (2) the pharmacist practices in a federally qualified
1925 health center, a hospital, a hospital-based clinic, or an academic
2026 health care institution;
2127 (3) the federally qualified health center, hospital,
2228 hospital-based clinic, or academic health care institution in which
2329 the pharmacist practices has bylaws and a medical staff policy that
2430 permit a physician to delegate to a pharmacist the management of a
2531 patient's drug therapy;
2632 (4) the pharmacist provides the name, address, and
2733 telephone number of the pharmacist and of the delegating physician
2834 on each prescription signed by the pharmacist; and
2935 (5) the pharmacist provides a copy of the protocol to
3036 the Texas State Board of Pharmacy.
3137 (g) In this section, "federally qualified health center"
3238 has the meaning assigned by Section 531.02192, Government Code.
3339 SECTION 2. This Act takes effect September 1, 2019.
